    The Legal Representative(s) of the Entity signing this opening of account form declare(s) that they are duly authorised to open an account with Moneybase Limited and Calamatta Cuschieri Investment Services Limited (‘CCMB’) that includes payment and investment capabilities in line with Board Resolution.

    The Legal Representative(s) on behalf of the Company further certify(s) that the information and documentation provided to CCMB is true, complete and up to date. The Company and its Legal Representative(s) undertake to inform of any changes related to the constitution of the Entity or related to their Directors, Signatories, Beneficial Owners, Key Controllers, Trustees, Beneficiaries or any party responsible to take decisions (also considerate as a “Related Parties”) within the Legal Person shall be communicated to CCMB as soon as practically possible and supported by documentary evidence pertaining to the said changes. 

    The Legal Representative(s) confirms on behalf of the Company having read, understood and accepted the Terms and Conditions and Data Privacy Policy of both Moneybase Ltd and Calamatta Cuschieri Investment Services Limited. The Legal Representative(s) request to open an account to allow transactions including deposits, withdrawals and investments in line with the limits set out in the opening of account form.

    I/We hereby confirm that the Legal Person and the involved parties have:  

    • Never been subject to EU, UN or any other international sanctions nor have carried out or intend to carry out transactions with sanctioned countries; 
    • Never been convicted of any offence related to financial subjects (excluding minor administrative infractions);  
    • Never been adjudicated bankrupt, insolvent or in any arrangement with the creditors; and 
    • Never been subject to asset seizures.  

    The Legal Representative(s) further acknowledge(s) that failure to comply with the Terms and Conditions or provision of any false information or documentation may result in account closure. The Legal Representative(s) commit(s) to settle any fees associated with the designated plan for the opening and maintenance of the account. 

    Indemnity  
    For the purposes of opening and managing the account, the Customer requests and instructs the Companies to accept, execute and respond to instructions as received by means of email, telephone or electronically through the platform. In order to communicate, the Companies’ will use the data provided by the Legal Representative(s) during the account opening and any subsequent information obtained through periodic reviews (email, address and phone number) provided by the Legal Representative(s) to receive account maintenance related communication. The communication initiated by the Companies may include email or telephone communication relating to:  

    (i) Request for information and/or documentation to support the information provided by the Customer; and 
    (ii) Request for confirmation of payments, transfers or any different type of transaction. 
     
    The Customer accepts that communication via email means shall be limited to requests for information and any other instructions received by email shall be disregarded in view of confidential nature of such requests and possible interference of any email correspondence. Consequently, the Companies cannot guarantee or take responsibility for the privacy or confidentiality of email communication or access by unauthorized third parties or corruption of any data being sent. The Customer therefore accepts the risks related to communication made by email. The Companies reserves the right to suspend any communication deemed suspicious or considered harmful. 
     
    The Customer can contact CCMB by means of chat, email and by telephone that are available through the platform and on the Moneybase website. Considering the nature of this legal relationship (financial sector), the communication between the Customer and Moneybase Ltd and Calamatta Cuschieri Investment Services Ltd is considered sensitive, and it is treated in accordance with the General Data Protection Regulation (EU) (2016/679) (“GDPR”). The detailed information regarding the Data Protection is available in the Data Privacy Policy. Moneybase Ltd and Calamatta Cuschieri Investment Services Ltd are authorized to keep the account open for the duration specified by the customer and until a written notice has been received by the customer. The companies are authorized to maintain records of information and documentation for a minimum period of 5 years from the date of account closure.  

    The Customer undertakes to immediately inform the Companies of any changes in the email address of the authorized representatives as indicated by the Company whenever such changes occur. The Customer hereby undertakes to keep the CCMB fully indemnified and free from claims, damages and charges or expenses which may occur as part of provision of services directly or indirectly for reasons of complying with instructions or requests. 

    All users created, individual and global account limits set as well as approval configurations on the account and respective wallets which are provided by the Customer at the time of opening the account or requested subsequently shall remain in force until such time that the Customer’s legal representatives, submit a change request through an official CCMB signed form and these instructions are duly processed by CCMB.
