This agreement is made between Motorcycling Queensland Limited ABN 24 009 666 424 (MQ) and {clubName} of {clubPostal} (Club).

In consideration of the Club paying the Affiliation Fee and agreeing to affiliate exclusively with MQ, MQ will provide the Affiliation Benefits to the Club.

1.  Definition of Affiliation
Affiliation is the formal recognition by MQ of an incorporated, not-for-profit club that conducts or supports motorcycle sport or recreation within Queensland. Affiliation grants the Club access to the rights, privileges, and benefits of participation under the Motorcycling Australia (MA) national framework and MQ governance structure, in return for the Club’s agreement to uphold all relevant standards, policies, integrity requirements and safety obligations.

1.1.  Affiliation with MQ is an exclusive arrangement recognising the Club as part of the national motorcycling structure under MA. Clubs cannot maintain concurrent affiliation or conduct any motorcycle activities with other motor sport bodies unless otherwise approved in writing by MQ.  Where a Club seeks to participate in, or conduct, motorcycle activities with another motor sport organisation, MQ may, at its sole discretion, issue an alternate agreement setting out the terms under which such activity may occur.

1.2.  In the event of a claim under the MA insurance program, where an MQ affiliated club is found to be affiliated with, aligns itself to, participates in, or initiates any motorcycle activities outside those sanctioned by MQ, a compulsory insurance deductible will apply: $10,000 each and every occurrence.   Clubs that are exclusively affiliated with the MQ the deductible will be $0.

2.  The Affiliation Fee is {affiliationType} incl GST, payable on receipt of Invoice.
In consideration of payment of the Affiliation Fee and compliance with this Agreement, MQ will provide the following benefits:

2.1.  The right to apply to MQ for event permits, which, if granted, confirm that the activities described in the relevant permit are covered by MA’s insurance program.

2.2.  Protection under MA insurance policies for:

2.2.1.  The Club committee under Directors’ and Officers’ liability insurance; and

2.2.2.  Entitlement to benefits payable under the MA personal accident policy for licensed riders, officials, licenced crew, accredited coaches and accredited media who suffer injury at permitted events.

2.2.3.  The Club’s MA-accredited coaches, cover under MA’s professional indemnity insurance while coaching under MA permit.

2.2.4.  The Club’s MA-accredited officials, cover under MA’s professional indemnity insurance while officiating under MA permit.

2.3.  Access to an established structure under which motorcycling activity may be undertaken designed to minimise risk to participants and to the Club including but not limited to:

2.3.1.  Comprehensive rules and procedures.

2.3.2.  Accredited officials and coaches.

2.3.3.  Eligibility to participate in MQ development initiatives, subcommittees, and awards.

2.3.4.  Access to MQ staff and support for club operations and event management.

2.3.5.  Recognition on the MQ website as an affiliated club.

2.3.6.  Access to MQ communications, marketing, and promotional support to assist in club growth.

2.3.7.  Access to a nationally accredited and recognised training programs.

2.3.8.  Access to MA’s electronic Ridernet platform and communications.

These benefits are subject to the Club’s continued compliance under this Agreement.

3.  By affiliating with MQ, the Club will:

3.1.  Take all steps necessary to ensure its constitution (and any amendments) conforms to MQ’s Constitution and has objects that align with MQ's Objects and do all that is reasonably necessary to enable MQ's Objects to be achieved.

3.1.1.  If the Club’s constitution does not conform to the MQ Constitution, the Club shall, without delay, take all steps necessary to address the inconsistency so that the documents conform to the MQ Constitution.

3.1.2.  If there is any inconsistency between a Club constitution and the MQ Constitution, the MQ Constitution prevails to the extent of that inconsistency.

3.2.  Acknowledge that MQ may develop and implement Regulations which may set out the membership criteria (of MQ) to be met by the Club and the privileges and benefits of membership of MQ which may include the right to receive notice of and attend MQ General Meetings subject to and in accordance with the MQ Constitution.

3.3.  Be responsible and accountable to MQ for fulfilling its respective obligations under MQ’s strategic plan as revised from time to time; working cooperatively with each other in the pursuit of the Objects of MQ.

3.4.  At all times:

3.4.1.  act for and on behalf of the interests of MA, MQ, the Members of MA/MQ and Motor Cycle Sport;

3.4.2.  act in good faith and loyalty to maintain and enhance MA, MQ and Motor Cycle Sport, its standards, quality and reputation;

3.4.3.  operate with, and promote, mutual trust and confidence; and

3.4.4.  not do, or permit to be done, any act or thing which might adversely affect or derogate from the standards, quality and reputation of MA, MQ or Motor Cycle Sport.

3.5.  Advise MQ as soon as practicable of any governance, administrative, operational or financial difficulties it is having and assist MQ in investigating those issues (if MQ determines to investigate) and cooperate with MQ in addressing them, including by allowing MQ to appoint a person to assist with the management of the Club’s business and affairs if required.

3.6.  Utilise Ridernet to the fullest possible extent for the administration and conduct of all events whilst affiliated with MQ unless MA and MQ have given their prior express exemption in respect of the event or series.

3.7.  Maintain a database in Ridernet of all Individual Members registered with the Club whether in accordance with the MQ Constitution or otherwise.

3.8.  Provide MQ with a copy of its annual general meeting minutes.

3.9.  Provide MQ with a copy of its constitution.

3.10.  Ensure that all committee members and volunteers/officials:

3.10.1.  hold a valid Working With Children Check (Blue Card); and

3.10.2.  have completed any relevant online Child Safe Awareness Courses (committee); and

3.10.3.  verify and record WWCC details in its database; and

3.10.4.  provide a copy to MQ to link to the organisation.

3.11.  Ensure the MA and MQ logo is prominently displayed on all electronic media (including its website and social media platforms), on all publications and communications, and at all MA-permitted events.

3.12.  Display its Certificate of Affiliation.

3.13.  Comply with MA policies including but not limited to:

3.13.1.  The MA National Integrity Framework including the Member Protection Policy.

3.13.2.  The MA General Competition Rules.

3.13.3.  The MA Track Standards.

3.13.4.  The MA Social Media Policy.

4.  Term: 

4.1.  This Agreement remains in force from date of affiliation up to an including 31 December 2026 unless terminated earlier in accordance with the following clause.

4.1.1.  MQ may terminate this Agreement, by giving the Club one calendar month’s written notice:

4.1.1.1.  if the Club becomes subject to any form of insolvency or administration; or

4.1.1.2.  if the Club is in breach of this Agreement, and fails to remedy the breach; or

4.1.1.3.  if the Club breaches any of the terms and conditions of affiliation, and fails to remedy the breach.

4.1.2.  MQ may, in its absolute discretion (acting reasonably), also suspend the Club’s affiliation agreement for such period as is determined by MQ where MQ considers it is in the best interests of the parties to do so.

5.  Resolution to Affiliation with MQ
At a duly constituted meeting of the Club, the following resolution was carried:

“That {clubName} resolves to formally affiliate with Motorcycling Queensland Inc. for the 2026 calendar year and agrees to be bound by the Constitutions, by-laws, regulations, and policies of Motorcycling Queensland and Motorcycling Australia, including the MA National Integrity Framework and Child Safe Standards.”

Child Safe Commitment Statement
MA and MQ are committed to promoting and protecting the safety and wellbeing of children and young people who participate in activities, programmes, services or facilities for which they are responsible.  MA’s Safeguarding Children and Young People Policy (Policy) seeks to promote and protect the rights of all children in the care of motorcycling entities and prevent abuse from occurring by promoting a child safe culture.  If a concern or allegation is raised in relation to child abuse that has occurred in the course of such participation, MA will ensure it is treated seriously, in a culturally sensitive manner and fully investigated in accordance with relevant legislation and the Policy. As a sport that prides itself in being open to and welcoming of anyone wishing to participate in it, MA and MQ will actively promote the safety and wellbeing of children and young people, whilst recognising the need for its affiliated state bodies and member clubs to take direct responsibility for providing a safe physical and online environment for children and young people who participate in their activities.
