This application is to authorize individual named above (hereinafter called "the Foster Caregiver") to care for pets in care of MuttLove Dog Rescue (hereinafter called "the Rescue").

Certain animals in the Greater El Paso and Las Cruces areas have and will be placed in the care of the Rescue and the Rescue will try to find foster homes which will adequately care for said animals until reclaimed or rehomed by the Rescue. The Foster Caregiver acknowledges that he or she is not becoming the owner of said animal(s), but is only willing to provide humane care for any such animal until it is claimed by its rightful owner, is adopted to another party in accordance with the Rescue policies, or other circumstances to be decided by the Rescue representative. In consideration of the premises and the covenants herein contained, it is agreed between the Rescue and Foster Caregiver as follows:

The Rescue will choose an animal for Foster Caregiver. The Foster Caregiver may choose whether they wish to care for said animal. If so, the Foster Caregiver agrees to humanely take care of said animal until the Rescue representative reclaims said animal. The Foster Caregiver will immediately, peaceably, and voluntarily surrender said animal to the Rescue upon request, and will make no claim of ownership, title, right, or interested in and to said animal.
The Foster Caregiver agrees to let the Rescue inspect the Foster Caregiver's premises where the animal is being kept at any time to ascertain and satisfy itself that the animal is well-cared for.
The Foster Caregiver agrees to keep a collar and identification tag provided by the Rescue on the animal at all times.
In the event the Foster Caregiver is a tenant of a rental property, the Foster Caregiver will provide proof of eligibility to keep animal on property as given by the landlord.
The Foster Caregiver agrees not to permanently alter in any way the appearance of the animal being fostered without written permission of the Rescue. This includes declawing and cropping of ears and tails.
The Foster Caregiver agrees to provide adequate food, water, shelter, and kind treatment for said animal at all times. In addition, the Foster Caregiver must adhere to all state and local animal laws. The Foster Caregiver agrees to follow all additional written instructions from the Rescue.
The Foster Caregiver agrees to notify the Rescue as to any behavioral or health problems of the animal. The Rescue reserves the exclusive right to determine the proper course of action to take upon such notification. The Rescue will, within a 24-hour period or less, determine if the animal will need health care and will make arrangements for such. If the Foster Caregiver makes the decision to take the animal to receive veterinary care without arrangements being made with the Rescue, no reimbursement for veterinary care will be provided to the Foster Caregiver.
The Foster Caregiver will notify the Rescue in the event any change occurs in the address or telephone number listed below within 24 hours prior to relocating. The Foster Caregiver understands and acknowledges that he/she does not have the right or authority to keep the animal or place the animal in other homes or place with other individuals unless permission is given in writing by the Rescue.
The Foster Caregiver is undertaking these obligations with no claim, now or in the future, to any type of compensation or reimbursement for caring for said animal, and the further consideration for undertaking this obligation of his or her own free will and be cause he or she wants to do so and derives satisfaction from doing so.
The Foster Caregiver agrees that accidental animal bites or other injuries to humans and other animals and animal-caused destruction to property do occur, and agrees to hold harmless and indemnify, and protect the Rescue, from any claim or suit filed by anyone as a result of such an incident. In addition, the Rescue will not be responsible if animal should damage or destroy property belonging to the Foster Caregiver, or should transfer any disease or internal or external parasites to other animals belonging to the Foster Caregiver.
If the owner does not reclaim the animal or it is not adopted to another entity, and the Foster Caregiver wishes to adopt said animal, the Foster Caregiver must go through the Rescue adoption program screening process. The Rescue reserves the right to determine final disposition of the animal. Should the Foster Caregiver want to adopt the animal, the Foster Caregiver should make a request in writing to the Rescue and fill out a Rescue adoption application.
The Foster Caregiver acknowledges that he or she is NOT THE OWNER of the foster animal. The Foster Caregiver, by evidence of their signature, acknowledge that the Rescue is the legal owner of the animal. The Foster Caregiver, by evidence of their signature, further acknowledges that the Rescue has the exclusive right to remove the animal from the Foster Caregiver at any time the Rescue deems necessary.
Any failure of the Foster Caregiver to adhere to the terms of this contract, including, but not limited to the unconditional return of the animal or any materials or supplies provided by the Rescue including, but not limited to, bowls, leashes, collars, uneaten food, unused puppy pads, and crates, at the Rescue's request, will constitute a breach of this agreement. The Rescue reserves the right to file criminal charges, not limited to THEFT, and also reserves the right to file litigation to recover their animal. Should litigation costs incur, the Rescue hereby gives the Foster Caregiver formal notice of its intent to seek any and all attorney's fees from the Foster Caregiver.
If the Foster Caregiver chooses to terminate this contract, 24 hours of notice will be given to the Rescue.
This Agreement is the entire agreement of the parties, and there are no oral promises or representations made in addition to this contract and it may only be changed in writing signed by both the Rescue and the Foster Caregiver.

I certify that all statements made by me on this foster agreement are true and correct. I agree that a MuttLove Dog Rescue representative has the right to rescind this contract and demand immediate return of the animal. In the event that any statements made by me are found to be false, subsequent violations of the terms and conditions of this contract are discovered, or if the pet is abused or mistreated in any way.
