CHECK IN AND CHECK OUT: The rental period begins at 4:00 p.m. on the day of arrival and terminates at 10:00 a.m. on the day of departure, unless prior arrangements have been made in writing. Please note that we cannot accommodate check in after 10:00 pm, so please make arrangements to arrive to the island by 9:00 pm. The property is professionally cleaned and inspected before and after each rental to ensure that all guests have a clean, comfortable stay. Please be thoughtful of renters who may be checking in on the same day that you checkout.
CANCELLATION: If guest needs to cancel for any reason, cancellation policy is as stated on the booking site on which you made the reservation. If booked direct, a full refund of the initial deposit will be given if cancelled more than 60 days prior to arrival. If cancellation notification is received more than 60 days prior to occupancy, then 100% of the initial deposit will be refunded (97% if paid via credit card). If the cancellation notification is received less than 60 days prior to occupancy then there will be no refund of any amounts. NOTE: Once you have paid your deposit you have agreed to these terms. We strongly suggest that you purchase travel insurance so that you are covered in case you need to cancel.
POOL WAIVER : Guests are renting the property in full knowledge that there is a pool, which is an integral part of the property. Due to the fact that the pool is not fenced and there is no lifeguard, it can pose a hazard to all persons who might enter therein intentionally and especially in the case of very young children. The only way to prohibit a person from entering said pool is by physically preventing such persons from doing so. Therefore, an Adult must supervise all children at all times. Guests acknowledge that the pool is only 6 feet deep and there is no diving allowed under any circumstances. Guests and their guests swim at their own risk and they accept complete responsibility and liability for any harm and agree not to attempt to establish a claim against the owners or their agents or hold them responsible unless it can be shown that the harm is attributable to the gross or willful negligence of the owners or their agents.
DAMAGE AND CLEANING ISSUES: Any damage or cleaning issues noticed upon arrival should be reported to the owner immediately. All general maintenance issues should also be reported so the unit can be kept in good repair. You will not incur any additional charges if the following items are adhered to: No damage is done to the unit or its contents, including the linens. No items are missing upon the inventory check. All debris, garbage and discards are placed in proper containers. All soiled dishes are placed in the dishwasher. There was no exceeding the maximum occupancy of the unit. There was no smoking or evidence of smoking. Unit is left in a clean, sanitary and safe condition.
If you experience any problems whatsoever with the vacation property during your stay, please contact us and we will do our best to rectify the matter as soon as it is practically possible. We make every effort to keep the property in good working order. Should a problem remain unresolved, you are required to notify us in writing within 7 days of your return. No action can be taken or liability accepted for any complaints received after this period. Please note that as Puerto Rico is a tropical location, insects such as ants, mosquito's, roaches, spiders and the like are occasionally inevitable, and are not cause for complaint. The vacation property is treated regularly as part of a pest and termite control program, and is cleaned after each rental.
NO SMOKING: Smoking is not allowed inside the property. Smoking is not allowed outside by any open window/door. Smoking is permitted on balconies as long as the doors and windows are closed.
NO PARTIES OR EVENTS: No parties or events are allowed in the property or on the premises.
NO PETS: Pets of any kind are not allowed in the property.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in or will be removed from the premises.
SEVERE WEATHER: We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit. You should consider taking out Vacation Travel Insurance during the hurricane seasons. If you are expelled from the property as part of a mandatory hurricane evacuation, you will be provided a pro- rated refund.
DAMAGE TO GUEST'S PROPERTY: Guest assumes sole risk and responsibility for all loss, damage and injury to their own property occasioned by fire, theft, water, storm damages, other elements or any other cause whatsoever, save for Owner's gross negligence.
GUEST assures that the tenants will observe all conditions and terms of this agreement as to maintaining the rental in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
GUEST assures that any tenant who violates any of the terms of this Agreement shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
GUEST agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
GUEST and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
GUEST agrees that during the term of this agreement and such further time as he/she occupies the premises, he/she will keep the rental clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment, furniture, artwork, and fixtures in the same condition as at the beginning of, or may put in during the term of the agreement (reasonable wear and tear excepted).
GUEST acknowledges that there is a security camera on the exterior of the building, facing the street.
Owners cannot accept any liability for your personal safety during your vacation. It is particularly important that children are supervised at all times in and outside the vacation property and especially around the pool area. We assume no responsibility for accidents. You are reminded to exercise care as to your personal safety, and the safety of your companions. Whenever possible, valuables should be left secure and out of sight. Guests should lock the property at night and when away from the property.
OWNERS RIGHT OF ENTRY: Owners or Owner's Agent may enter the premises at reasonable times and with reasonable notice to Guest in order to protect, inspect, show or make repairs on the premises.
ATTORNEYS FEES: In the event a claim is made on this contract or any of its terms, the prevailing party in litigation is entitled to recover actual attorneys fees and costs.
CHOICE OF LAW AND VENUE SELECTION: The Parties agree that any proceeding or action that might be initiated to enforce or interpret the terms of this Agreement will be brought only in Waukesha, WI and that Wisconsin law or, if applicable, federal law will apply in such proceeding.
