Hold Harmless Agreement Riders/ Volunteers/Visitors

Location: 16 Cedar Farm Lane, Rising Sun MD 21911

In consideration of the services of Opening Number Riding Academy, LLC, their agents, owners, volunteers, participants, employees, Amos Beiler and his family of Cedar Farm, and all other person or entities acting in any capacity on their behalf (hereinafter collectively referred to as ONRA I hereby agree to release, indemnify and discharge ONRA, on behalf of myself, my children, my parents, my heirs, assigns, personal representatives and estate as follows:

1. I acknowledge that horseback riding and all equine handling entails known and unanticipated risks that could result in physical harm, or risks that simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include but are not limited to: loss of control; collisions; horses and other equines, irrespective of their previous behavior and characteristics, may act or react unpredictably based upon instinct, fright, or lack of proper control by rider, latent or apparent defects or conditions in equipment, my own acts or omissions; the condition of trails and accidents connected with their use; first-aid, emergency treatment, or other services rendered.
   
2. I expressly agree and promise to accept and assume all the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. I also agree that any guests brought on my behalf will follow safety rules and understand all risks assumed around equines.
   
   
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless ONRA from any and all claims, demands, or causes or action, which are in any way connected with my participation in this activity or my use of ONRA's equipment or facilities, including any such claims which allege negligent acts of omissions of
   
   
4. Should ONRA or anyone acting on their behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
   
   
5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself.
   
   
6. In the event that I file a lawsuit against ONRA, I agree to do SO solely in the State of Maryland, and further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portion shall remain in full force and effect.
   
   
7. I authorize and consent to any emergency medical care which may at the time appear reasonably appropriate under the circumstances as a result of injury or sickness that may or may not be caused by equine activities.
   
   
8. I agree to use an ASTM approved helmet of proper fit, as well as wear appropriate clothing and shoes around the horses and other equines. I understand that the farm provides safety equipment such as helmets and boots. I have been advised on the necessity of acquiring additional proper riding attire including but not limited to proper boots, chaps, gloves, breaches, undergarments, and safety vests and understands that it is my responsibility to educate myself on the acquisition and use of proper attire and equestrian safety equipment. I agree to wear approved clothing to respect the owner's beliefs, and will ensure that myself and my guests are dressed modestly per Amish traditions.
   
   
9. I understand that it is also my responsibility to check the safe and proper application of any and all equine related riding equipment including but not limited to saddles, girths, bridles, boots etc. If I am unsure of any of the equipment's applications or quality, I must notify the instructor or other employee. If using a private owner's animal, I agree to keep open communication with them, and will ask the animal's owner for proper usage of equipment. All private owner usage must have written communication to verify permissions.
   
   
10. I agree to make sure that I pay for any and all services provided by the above equine professionals must be paid in full at time the service is rendered unless other arrangements are made prior to the lesson, training etc. I understand that if my card does not work, or if I write a bad check, I will be responsible for the accrued fees.
11. I agree to maintain a positive image and environment while at and/or representing ONRA. This includes, but not limited to, posting on social media, engaging with other customers, and handling the animals. I agree to promote and foster a professional attitude: dedicated, productive, positive, safe, pleasant, creative, and collaborative. I will treat others with respect and courtesy.

By signing this document, I acknowledge that if anyone is hurt or property damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against ONRA on the basis of any claim from which I have released them herein.

I had sufficient opportunity to read this entire document. I have read and understood it, and agree to be bound by its terms.

PARENT'S OR GUARDIAN'S ADDITIONAL INDEMNIFICATION

In allowing the minor mentioned earlier being permitted by ONRA to participate in its activities, I further agree to indemnify and hold harmless ONRA from any and all claims which are brought by, or on behalf of the minor, and which are in any way connected with such use or participation of the minor.

For good and valuable consideration, the receipt of which is hereby acknowledged, I hereby consent to the photographing of myself and the recording of my voice and the use of these photographs and/or recordings singularly or in conjunction with other photographs and/or recordings for advertising, publicity, commercial or other business purposes. I understand that the term "photograph" as used herein encompasses both still photographs and motion picture footage. I further consent to the reproduction and/or authorization to reproduce and use said photographs and recordings of my voice, for use in all domestic and foreign markets. Further, I understand that others, with or without the consent may use and/or reproduce such photographs and recordings. I hereby release ONRA and any of its associated or affiliated companies, their directors, officers, agents, employees and customers, and appointed advertising agencies, their directors, officers, agents and employees from all claims of every kind on account of such use.
