I UNDERSTAND THE RISKS AND AGREE TO PLAY
IMPORTANT: By accepting this document, you acknowledge that you have read, understood and agreed to its terms. 1. Participation and Risk Warning: Australian Beach Sports Academy Inc. (“ABSA”) conducts and facilitates beach sports activities including social and competitive games, competitions, tournaments, coaching, training, clinics, practice sessions and related activities (“Activities”). I understand and acknowledge that participating in beach sports involves inherent risks of physical injury. These risks include being struck by a ball, collisions with other players, officials, equipment or other persons, falls, slips, trips, awkward landings, strains, sprains, fractures and other injuries associated with running, jumping, diving and playing beach sports. Risks may also arise from sand, debris, uneven or changing playing surfaces, weather, heat, sun exposure, dehydration, equipment, the actions of other participants and other circumstances that may be outside ABSA's reasonable control. I understand that injuries may be serious and that not every risk associated with participating in beach sports can be anticipated, controlled or eliminated. 2. Acknowledgement and Acceptance of Risk: I voluntarily choose to participate in the Activities and acknowledge and accept the inherent and obvious risks associated with doing so. I understand that I am responsible for determining whether I am physically and medically capable of participating safely and agree to disclose any injury, illness, medical condition or other circumstance of which I am aware that may materially affect my ability to participate safely or create a material risk to others. I will not participate while affected by alcohol, illicit drugs, medication or another substance to an extent that may impair my judgement, coordination, physical ability or capacity to participate safely. I acknowledge that conditions may change before or during an Activity and accept that my personal property may also be lost, stolen or damaged while participating in or attending an Activity. 3. Participant Conduct and Responsibilities: I agree to comply with ABSA's reasonable rules, instructions, safety requirements and directions and to participate responsibly with reasonable regard for my own safety and the safety of others. I understand that my actions may cause injury or damage to another person or their property and agree to use facilities and equipment appropriately and notify ABSA of any significant hazard, accident, injury or incident of which I become aware. ABSA may refuse, prevent or suspend my participation where ABSA reasonably considers this necessary for safety, conduct, operational or other legitimate reasons. 4. Recreational Services, Release and Waiver: I acknowledge that ABSA may be supplying recreational services in connection with my participation in the Activities. To the maximum extent permitted by law, including under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law and applicable Queensland legislation, I voluntarily assume the risks associated with participating in the Activities and release and discharge ABSA, together with its officers, committee members, employees, coaches, instructors, referees, officials, contractors, volunteers, representatives and agents, from claims, demands, liabilities, losses, damages, costs or expenses arising from or connected with my participation in the Activities, including personal injury or property loss or damage, except to the extent that liability cannot lawfully be excluded, restricted or modified. Nothing in this document is intended to exclude, restrict or modify any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified. 5. Indemnity: To the maximum extent permitted by law, I agree to indemnify and hold harmless ABSA and its officers, committee members, employees, coaches, officials, contractors, volunteers, representatives and agents against claims, liabilities, losses, damages, costs or expenses arising from my negligent, reckless or unlawful acts or omissions, my breach of this agreement or ABSA's reasonable rules or directions, or injury, loss or damage caused by me to another person or their property. 6. Medical Treatment: If I become injured or unwell while participating in or attending an Activity, I authorise ABSA to provide or arrange reasonable first aid, emergency assistance, medical treatment, ambulance transport or evacuation where reasonably considered necessary. Where I am unable to provide consent at the relevant time, I authorise ABSA to take reasonable action considered necessary to protect my health or safety. To the extent permitted by law, I accept responsibility for reasonable ambulance, medical, hospital or other third-party treatment costs incurred on my behalf that are not otherwise covered by insurance or anotherarrangement. 7. Personal Property: I understand that I am responsible for my personal belongings while attending or participating in ABSA Activities. To the maximum extent permitted by law, ABSA accepts no responsibility for personal property that is lost, stolen or damaged in connection with an Activity, except where liability cannot lawfully beexcluded. 8. Privacy and Personal Information: I acknowledge that ABSA may collect, hold, use and disclose personal information associated with my registration, membership and participation in accordance with ABSA's Privacy Policy. Personal information may be used for purposes reasonably connected with the operation, administration, management, development and promotion of ABSA and its Activities, including registrations, programs, competitions, communications, health and safety, insurance, record keeping and other legitimate organisational purposes. 9. Photography, Video and Media: I acknowledge that photography, filming and video recording may occur during ABSA training sessions, games, competitions, events and other Activities. Due to the nature of sporting activities, I understand that participants may be photographed or recorded individually, as part of a group, during gameplay or incidentally in the background. As a condition of participation, I acknowledge and agree that ABSA may take photographs, images and video recordings during its Activities and may use, reproduce, publish and distribute such material for purposes reasonably connected with the operation, development, marketing and promotion of ABSA, its programs, Activities, events and achievements. This may include use on ABSA websites, social media channels, digital communications, online advertising, newsletters, promotional materials, presentations, printed materials and other media. I understand that photographs and recordings published online or through social media may be publicly accessible and may be viewed, copied, shared or reproduced by third parties outside ABSA's control. ABSA will use reasonable judgement when selecting photographs and recordings for publication, particularly where children or young people are identifiable, and will not knowingly publish material that it considers inappropriate or inconsistent with ABSA's Activities or purposes. Where a participant, parent or guardian has a particular safety, legal or other serious concern regarding the publication of an identifiable image, they should notify ABSA so that the circumstances can be considered. Due to the nature of beach sports and sporting activities, ABSA cannot guarantee that a participant will not appear in photographs or recordings of gameplay, training, competitions, events or other ABSA Activities. By accepting this waiver and participating in ABSA Activities, I acknowledge and accept the photography, recording and use of images described above. 10. General: If any provision of this document is found to be invalid, unlawful or unenforceable, that provision is to be read down to the extent necessary or, if it cannot be read down, severed without affecting the remaining provisions. This document is governed by the laws applicable in Queensland, Australia. 11. Participant Declaration and Acceptance: I acknowledge that I have read and understood this document and have had the opportunity to ask questions or seek advice before accepting it. I understand that beach sports and the associated Activities involve inherent risks and that this document contains provisions concerning assumption of risk, release, waiver and indemnity that may affect my legal rights. I confirm that the information I have provided to ABSA is, to the best of my knowledge, accurate and complete. I accept these terms and choose to participate freely and voluntarily. Participant Under 18 Years of Age: Where the participant is under 18 years of age, I confirm that I am the participant's parent or legal guardian, or am otherwise legally authorised to provide this consent. I have read and understood this document and consent to the participant taking part in ABSA Activities subject to these terms, including the provisions concerning risk, medical assistance, privacy, photography, video and media.
