It is hereby declared and agreed upon between Pip Easton and Francois Kruger of Infinity Equestrian and the undersigned, who states as follows:
1. I am aware that being in close proximity to horses contain inherent risks of injury and/or death to me personally, caused by accident, my own negligence or the negligence of others. Horses can be hazardous because even if the person is knowledgeable with horses sometimes act unpredictably to environmental changes, or unfamiliar sights or noises. Accidents can cause serious injury or death to the participant. In addition, injury and/or death can occur due to the negligence of third parties. The failure by the participant to adjust in awareness properly can result in injury and death. When participating in groups, the participant and/or horse may suffer injury and/or death because of the actions of another participants and/or horse.
2. Knowing these facts, I nevertheless, in consideration of the acceptance of this agreement by Pip Easton, lesson, workshop, seminar and clinic sponsors, property owner(s) Kelico Equestrian Park, Mary's Creek, hereby for myself, my heirs, executors and administrators, assume the risk of these and similar dangers and waive any claims against, release and forever discharge Pip Easton and their employees, agents, volunteers and representatives (and their heirs, executors, administrators and assigns) from any and all right, claim or liability for damages, or for injuries and/or death that might be sustained by me (including injury to animals), or from any and all claims of any kind or nature that I might have as a result of, or arising out of receiving riding instructions.
3. This release will extend to any accidents, damages or claims whether arising out of my own actions (or the actions of other horses with in my control), or the acts of others which have resulted in injury and/or death to me.
4. If the Lesson, Workshop, Seminar or Clinic is conducted on property leased or owned by the federal, State City or Australian Governments also release the federal, State, City or Australian Governments, their insurance authority, agents, officers, servants and employees from all liability for any acts of negligence or want of ordinary care on their part of the above named governments and/or any of their agents.
