By signing this Waiver, you and/or your child are giving up certain legal rights, including the right to sue or recover damages in case of injury, death or property damage, for any reason, including, but not limited to, negligence of Power Up Cheer Academy, LLC ("Power Up Cheer"), its owners, members, managers, employees, agents and affiliates. For purposes of this Waiver, "undersigned" is defined as the participant ("Participant"), the parent or legal guardian of the Participant, and their respective executors, assigns, administrators, attorneys, agents, representatives, and heirs. I, as parent or legal guardian of Participant, hereby grant permission for Participant to participate in all and or any of the Power Up Cheer training programs, classes, camps etc. Disclaimer. Power Up Cheer is not responsible for any injury (or loss of property) to any person while practicing, training, competing, participating or in any way involved in the training programs organized by Power Up Cheer for any reason whatsoever, including negligence on the part of Power Up Cheer, its owners, members, managers, employees or agents. In consideration for Participant's participation in the training programs offered by Power Up Cheer, the undersigned hereby releases, waives, discharges and covenants not to sue Power Up Cheer, its owners, members, managers, employees, or agents (hereinafter referred to as "Releasees") from all liability to the undersigned for any loss, damage claim, judgment, cost or expense (including attorneys' fees) arising out of or in connection with Power Up Cheer's training programs or any activities incidental thereto, including any claim arising out of orin connection with any illness or injury (minimal, serious, catastrophic and/or death) that Participant may incur or sustain. The undersigned is aware that playing or practicing any sport or athletic activity can be dangerous and involves a risk of injury. The undersigned understands that the dangers and risks of playing or practicing cheerleading include, but are not limited to, death, serious neck and spinal injuries which may result in complete or partial paralysis or brain damage, serious injury to virtually all bones, joints, ligaments, muscles, tendons, and other aspects of the muscular-skeletal system and serious injury or impairment to other aspects of Participant's body, general heath, and well- being. Because of the increased risk of injury participating in cheerleading, the undersigned recognizes the importance of following the coach's instructions regarding following safe progressions, safety techniques, proper and sequential lead-up skills, and safety guidelines.
