PAYMENT POLICY * This field is required.Initial Retainer: A non-refundable retainer fee of 33% of the total estimated cost is required to secure our services and initiate the design process. This payment is due upon signing the contract. Midway Payment: A second payment of 33% of the total estimated cost is due during the midway call, which is scheduled 30 days but no later than two weeks prior to the event. This payment covers any final edits and design proofs. Final Payment: The remaining balance of 34% of the total estimated cost is due no later than 48hrs before the event day. This final payment activates our insurance policy to cover any liabilities that may arise during the event. Late Payment: Any payment not received by 48 hours of the event date my result in a delay or cancellation of services. A late fee of 25% of the event cost may be applied to payments received after the due date. Payment Methods: Payments can be made via Visa, Mastercard, American Express, Zelle, Venmo, Apple Pay, Cash App, Corporate Check Cancellation Policy (see cancellation policy): In the event of cancellation, the initial retainer fee is non-refundable. Cancellations made within 30 days of the event date may result in forfeiture of the full payment. Insurance Coverage: By making the final payment, the client acknowledges and agrees that any claims made against the contract will be covered by our insurance policy, subject to the terms and conditions of the policy. Changes to Contract: Any changes to the contract must be agreed upon in writing by both parties. CANCELLATION POLICY:* This field is required.Cancellation Deadline: Clients must provide a written cancellation notice no later than 30 days prior to the scheduled event date to receive a partial refund of their payment, excluding the initial retainer fee. Partial Refund: A cancellation notice received more than 30 days prior to the event date will result in a refund of 50% of the total payment, excluding the non-refundable initial retainer fee. The initial retainer fee is non-refundable and serves as a cancellation fee. Late Cancellation: Cancellations received less than 30 days prior to the event date will result in forfeiture of the full payment, including the initial retainer fee. Cancellation Process: Cancellation notices must be submitted in writing via email to info@onemagicalevent.com The cancellation date will be the date on which the written notice is received. Refund Processing: Refunds for cancellations will be processed within 30 days of receiving the cancellation notice. Non-Refundable Nature: The initial 33% retainer fee is non-refundable and forfeited immediately after it is paid, due to the commitment of resources and planning that has already been undertaken. PHOTO BOOTH OPERATIONS: * This field is required. PHOTO BOOTH OPERATIONS: One Magical Event agrees to have the photo booth operational for the time period specified in the contracted invoice. However, in some situations, operations may need to be interrupted for maintenance, service, and/or photography optimizations, or for attendant restroom breaks, not exceeding 10% of the event's total time. One Magical Event agrees to send a qualified technician onsite to maintain and operate the photo booth. Should One Magical Event fail to provide a fully operational photo booth during the agreed-upon times or for 90% of the event's duration, the client's sole remedy is a refund of payment. Client acknowledges and agrees that One Magical Event will not be responsible for any consequential damages. If only partial services can be provided due to conditions beyond our reasonable control, then the rental charges shall be on a prorated basis.

PHOTO BOOTH SETUP / TEAR DOWN: * This field is required.PHOTO BOOTH SETUP / TEAR DOWN: One Magical Event will deliver, set up, and remove the photo booth from the event location. Operation of the photo booth times may not be adjusted if the event location or client ends the event prior to the contracted end time, and no refund of money will apply. The area designated for the photo booth setup must be reasonably accessible and have level ground. One Magical Event requires access to the venue at least 60 minutes before the event and 60 minutes after the event for setup and take down.

SPACE & PLACEMENT REQUIREMENTS: * This field is required. SPACE & PLACEMENT REQUIREMENTS: Client agrees to provide: (1) A minimum area of 6’ x 8’ for our photo booth. (2) Access to a 110V, 20 amps, 3-prong standard electrical outlet within 20 feet of our designated area.

INCLEMENT WEATHER: * This field is required.INCLEMENT WEATHER: One Magical Event reserves the right, in good faith, to cease operation should inclement weather pose a potential danger to our personnel, equipment, or guests. Safety is our top priority, and therefore, One Magical Event's compensation will not be affected if the operation is ended due to inclement weather.

FORCE MAJEURE EVENTS * This field is required.FORCE MAJEURE EVENTS: In the event of any force majeure event (including but not limited to plague, epidemic, pandemic, outbreak of infectious disease, or any other public health crisis, including quarantine or other restrictions), One Magical Event reserves the right, in good faith, to cease operation. The Client agrees to indemnify and hold harmless One Magical Event and any photo booth attendants (who are independent contractors or employees working with One Magical Event at the time) against any and all liability related to the Client's event, from the time of service and into the future.

LIABILITY AND INDEMNIFICATION: * This field is required. LIABILITY AND INDEMNIFICATION: One Magical Event shall not be liable, under any contract, for direct, indirect, incidental, or consequential damages (including, without limitation, damages for lost profits or increased expenses) related to any claim arising from or related in any way to this agreement and services provided. The Client agrees to indemnify and hold harmless One Magical Event and any photo booth attendants (who are independent contractors or employees working with One Magical Event at the time) against any and all liability related to the Client's event, from the time of service and into the future. The Client will assume all legal fees claimed by third parties, provided that such loss or damage was not caused by the fault or negligence of One Magical Event, its employees, agents, or subcontractors.

DAMAGE TO EQUIPMENT: * This field is required. DAMAGE TO EQUIPMENT: The Client acknowledges responsibility for any damage or loss to One Magical Event's equipment caused by: a) misuse of the equipment by the Client or its guests, b) theft, or c) disaster (including but not limited to fire, flood, or earthquake). Additionally, the Client acknowledges that One Magical Event is not liable for any loss of power or power surges to the photo booths at any time, resulting in the loss of pictures or damage to software and/or equipment.

MODEL RELEASE: * This field is required.MODEL RELEASE (exclusions upon request): All guests using the photo booth hereby grant One Magical Event the right and permission to copyright and use photographic portraits or pictures of any photo booth user who may be included, intact or in part, made through any and all media now or hereafter known, for illustration, art, promotion, advertising, trade, or any other purpose.

UNDER AGE CHILDREN:* This field is required. UNDER AGE CHILDREN: All guests independently using any photo booth equipment must be 13 years of age or older. Any child under 13 years of age must be accompanied by a parent or someone over the age requirement. It is prohibited by copyright law to use any photographic portraits or pictures of any photo booth users under the age of 13 without an adult present. We are unable to take photographs of children when a parent is not present. The photo booth will be required to be shut down until the matter is resolved.

ONLINE GALLERY:* This field is required.ONLINE GALLERY WITH YOUR DOWNLOADABLE DIGITAL PICTURES: By approving One Magical Event to host event images online, the client releases, discharges, and agrees to hold harmless One Magical Event from any liability that may occur or be produced in the taking of said pictures or in any subsequent processing or publication thereof, including claims for libel or invasion of privacy. If any provision of these terms is unlawful, void, or unenforceable under Contract Law, that provision shall be deemed separate from the rest of this contract and shall not affect the enforceability or validity of any remaining provisions.

AGREEMENT * This field is required. AGREEMENT: This constitutes the entire agreement between One Magical Event and the Client concerning the subject matter herein and may only be modified in writing, digitally signed by the client, host, or authorized event representative. In the event of a conflict between the parties, the Client agrees to resolve any disputes via arbitration. This agreement supersedes all prior oral, written, and other agreements between the parties regarding the subject matter herein. Any unlawful, void, or unenforceable provision of these terms shall be deemed separate from the rest of this contract and shall not affect the validity or enforceability of any remaining provisions.
