In recognition of the potential risk of injury involved in participating in the BREATHE RELAX & RELEASE SUPPORT GROUP (referred to as the “Activity”), and

Considering my willingness to take part in the Activity, with the opportunity granted to me to do so;

I, for myself and my heirs, executors, administrators, assigns, or any other personal representatives (collectively referred to as "I" or "me"), willingly enter into this Waiver and Release of Liability. I voluntarily waive any rights, claims, or legal actions stemming from my participation in the Activity.

I hereby release and forever discharge and hold harmless, RADICAL ELEVATION, located at 3551 E Bonanza Rd, Las Vegas, Nevada 89110, along with their affiliates, agents, attorneys, staff, volunteers, and other representatives (collectively referred to as "Releasees"), from any physical or psychological harm and/or any other harm foreseeable or unforeseeable that may result from my participation in the Activity.

I understand and acknowledge that I am voluntarily engaging in this Activity at my own risk. I am aware that this participation could lead to various forms of harm, including but not limited to: physical or emotional injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional distress, and even death. I am also aware that these outcomes may arise from my actions or those of others, conditions related to travel, or circumstances at the location of the Activity. Despite these risks, I accept full responsibility for all risks, known or unknown, associated with my participation in this Activity.

I also agree to defend, indemnify, and hold the Releasees harmless from any claims, legal actions, or lawsuits, including attorney’s fees and related costs.

Additionally, I acknowledge that the Releasees are not liable for any errors, omissions, acts, or failures to act by third parties involved in organizing or managing the Activity. In case of a medical emergency, I authorize Radical Elevation to provide any necessary emergency medical care, including but not limited to first aid, CPR, AED use, and emergency transportation, as well as sharing my medical information with emergency personnel. I agree to bear any costs associated with such treatment and acknowledge that I should carry my own health insurance.

I further acknowledge that this Activity may push my physical and mental limits, potentially leading to death, serious injury, or property damage. I agree to participate only if I am medically fit and properly prepared, and I will adhere to any decisions made by Radical Elevation's officials regarding my eligibility to participate.

I understand that by signing this agreement, I am giving up my right to sue Radical Elevation and its affiliates for any personal injury or property damage I may experience while participating in the Activity.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for such negligence on the part of Radical Elevation, its agents, and employees.

This agreement will be governed by Nevada law.

If any damage to equipment or property happens because of actions, negligence, or carelessness on my part or my family's part, I accept responsibility and agree to cover all related costs.

This waiver and release of liability will stay valid throughout my involvement in the activity, including this event and any future events of participation.

This agreement was made fairly and voluntarily, with no pressure or coercion, between two parties who are equal in bargaining power. Both the Participant and Radical Elevation agree that this Agreement is clear and specific in its terms, and no other evidence will be used to change or interpret the terms. The Agreement will be understood according to its language and purpose.

If any part of this Release of Liability is found to be invalid or unenforceable, the rest of the agreement will still remain in effect. If a court decides that a provision is unenforceable but could be made valid by limiting it, then it will be enforced with those limits in place.
