Waiver and Assumption of Risk Agreement
In consideration of my (or my minor child’s) participation in speed and agility training sessions with EV Baseball Academy, I hereby acknowledge and agree to the following terms:
1. Acknowledgment of Risks
I understand and acknowledge that participating in speed and agility training involves certain inherent risks, which may include but are not limited to, physical injuries such as sprains, muscle strains, fractures, concussions, or other injuries. I understand these risks and accept them as part of the training experience.
2. Voluntary Participation
I affirm that my participation (or my child’s participation) in speed and agility training is entirely voluntary, and I knowingly assume all risks associated with such activities, including those that may arise from the negligence of EV Baseball Academy or any of its instructors, employees, or representatives.
3. Release and Waiver of Liability
I, on behalf of myself, my heirs, personal representatives, and assigns, hereby waive, release, and forever discharge EV Baseball Academy, its owners, trainers, employees, and affiliates from any and all claims or causes of action for any injury, illness, or loss that may occur during or as a result of my participation (or my child’s participation) in the training program, whether caused by negligence or otherwise.
4. Medical Consent and Responsibility
In the event of an emergency, I authorize EV Baseball Academy to provide necessary first aid and arrange for emergency medical treatment if needed. I agree to bear any costs associated with such treatment and understand that EV Baseball Academy is not responsible for any medical expenses.
5. Photo and Video Consent
I give permission to EV Baseball Academy to use photographs and video recordings taken during training sessions for marketing, promotional, or educational purposes. I understand I will not receive compensation for the use of such media.
6. Indemnification
I agree to indemnify and hold harmless EV Baseball Academy, its trainers, employees, and affiliates from any claims, damages, or liabilities arising from my (or my child’s) participation in speed and agility training.
7. Acknowledgment of Understanding
I have read and fully understand this waiver and release of liability, and I agree to the terms freely and voluntarily. I acknowledge that I am giving up legal rights by signing this document and intend it to be a complete and unconditional release of liability to the maximum extent allowed by law.
