INTIMATE / BOUDOIR PHOTOGRAPHY ACKNOWLEDGEMENT:
Client understands and acknowledges the sensitivity of this type of Session; specifically, that the Photographers may suggest to Client that Client pose in sexually suggestive poses and clothing, including implied, partial or full nudity. Client understands and acknowledges that it is acceptable to refuse any particular pose or outfit that is beyond Client’s comfort level. Client acknowledges that s/he is at least 18 years of age, is entering upon this Agreement without coercion, and has the authority to make decisions for themselves.
EXLUSIVITY
Client acknowledges and agrees that the Photographers will be the exclusive provider of the Services in the Session, unless otherwise agreed to by the parties in writing.
RESCHEDULING
If an illness or situation prevents a photo session from taking place, the Client may reschedule their session at least 48 hours prior to their shoot without penalty. Should the Client fail to give a 48 hour notice, or wishes to cancel the photography session, the Initial Payment agreed upon shall be retained by the Photographers. The Photographers reserve the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. The Photographers will only wait 15 minutes past the session time if the Client is late. If Client is a no call, no show for their session, the Photographers will keep the Initial Payment and the Client forfeits their ability to reschedule their session.
RE-SHOOTS
Re-shoots are determined at the discretion of the Photographers. Re-shoots will not be given for poor choices of clothing, make-up, hair, or by not following the recommendations of the Photographers.
GALLERIES
Online galleries of Client's digital images will be available within 21 business days after the session date. Digital images will be available in the gallery for at least one year after the session date. Client acknowledges that NO printed images or physical discs/USBs/etc will be provided.
ORDERING
The Client will have the ability to download images from the online gallery and order prints from any photo store of their choosing. Images can also be ordered directly from the online gallery for a pre-determined price.
LIABILITY
The Photographers are not responsible for any injuries inflicted upon any participating parties. Client will be responsible for themselves and their children, and release the Photographers from any claims against their person or their business.
INTELLECTUAL PROPERTY
Copyright Ownership. In the event that any copyrighted work(s) are created as a result of the Services provided by the Photographers in accordance with this Agreement, each individual Photographer owns all copyrights in any and all work(s) (ex: photographs, images) they create or produce pursuant to Federal Copyright Law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by the Photographers, regardless of permitted use.
Permitted Use of Image(s). The Photographers grant to Client a non-exclusive license of image(s) produced with and for Client for personal use only so long as Client provides the Photographers with attribution each time Client uses the Photographer's property. Personal use includes, but is not limited to, use within the following contexts:
In photos on Client’s personal social media pages or profiles; or
In personal creations, such as a scrapbook, photo book, framed photo or personal gift; or
In personal communications, such as a family newsletter, email or holiday card.
The Photographers will not release any RAW image files.
EDITING
The Client understands and agrees that no additional editing may be done to the images by anyone other than the Photographers. This includes adding filters from social media websites and apps, screenshots (alters the image quality), and any further adjustments not done by the Photographers.
SOCIAL MEDIA
If the Client is unsatisfied with the final delivery of the images, they are to contact the Photographers privately. The Client understands that they are not to post to social media in any way slandering Robyn Morrill and RLC Photography, LLC or Carrie Hogan and Carrie Hogan Photography.
