Membership Application/ Note: your application will be reviewed and if approved you will receive your door code with 24 hours during normal business days. If it’s the weekend it will be reviewed on Monday for approval. Codes and memberships cards will be texted to the number you provided on this application.

BANKING INFORMATION:

I/We here by request in person the privilege of Royse City Fitness LLC ("the Company) and further authorize the Company to draw items (checks, electronic fund transfers, credit card or debit card) for the purpose of paying said payments as stated in this agreement including any late fee's, service fee's, or increase of monthly dues on the accounts listed in this agreement.

DEFAULT AND LATE PAYMENTS: Should you default on any payment obligation as called for in this agreement, the club will have the right to declare any remaining balance due and payable and you agree to pay allowable interest, and all cost of collection, including but not limited to collection agency fees, court costs, and attorney fees. A default occurs when any payment due under this agreement is paid late. Should any monthly payment become past due, you will be charged a late fee. An additional service fee will be assessed for any check, draft, credit card or order returned for insufficient funds or any other reason. If the member is paying monthly dues by electronic funds transfer (EFT), the club reserves the right to draft via EFT all amounts owed by the member including any and all late fees and service fees. Subject to State and Federal law. NOTE: Members paying monthly dues by EFT are subject to an additional $5.00 per month increase of monthly dues per membership if EFT payment has a stopped payment or returned for insufficient funds. This will not effect any other provisions in this agreement. Payment drafts will be conducted on the 1st & 15th of each month. The first years annual enrollment fee’s will be paid upon sign up and each year the annual enrollment fee(s) will be drafted from the account provided by the member on or about the original sign up dates yearly anniversary and is non refundable. I/We here by request the privilege of Royse City Fitness LLC (“the Company) and further authorize the Company to draw items (checks, electronic fund transfers, credit card, debit card) for the purpose of paying said payments as stated in this agreement, including any late fee’s, service fee’s, or increase of monthly dues on the accounts in this agreement.

Subject to the fallowing conditions: The monthly dues shall be drawn on or about the dates of the payment schedule. The transaction on your bank statement will constitute as a receipts for payment on your account. The privilege of making payments under this agreement may be revoked by Royse City Fitness LLC if any dues are not paid upon presentation. A service fee will be accessed and drafted for any check, draft, credit card or debit card, or electronic fund transfer returned for insufficient funds or any other reason. This preauthorization payment arrangement shall apply to the following Applicants:

Your billing cycle payment date will be the first available date of either the 1st or the 15th of each month determined upon your sign up date of enrollment.

Automatic Renewal Program: Provided that member(s) are not in default of this agreement and subject to the terms and conditions hereof, the membership will automatically renew monthly for the indicated rate with sales tax selected for all memberships selected in this aggrement and annual dues for each primary member will be billed annually on the date the membership begins or slightly after in the amount of $99 per membership over the age of 16. Renewal terms may canceled any time by providing a 30 day written notice that is mailed to 603 Lula St. Royse City TX 75189 (The post marked date will indicated the start date of the 30 day notice) it is also understood that the club has the option to increase monthly renewal dues without notice during any renewal period not to exceed $10 per member per month and annual dues yearly not to exceed $10 per year in an increase without providing member(s) notification. Members Initials:

Member(s) hereby acknowledges to Royse City Fitness and its employees, agents, independent contractors, and affiliates (all together, “Club Activities”) allow the Member to engage in various exercise and physical activities potentially beneficial to the fitness, health, and well being of the Member(s). However, the Member(s) also hereby acknowledges to the Club that the Member recognizes that there are inherent risks of various physical and mental conditions, illnesses, and injuries associated with engaging in any exercise or physical activities such as the Club Activities or the use of the facilities of any health and fitness club such as the Club Facilities, and that such risks may be compounded by the fact many of the Club Activities are unsupervised, including without limitation, the use of various exercise machines and equipment in the Club Facilities, childrens activity center, and the access to use of the dressing, shower, lounge, locker, and any an all other areas of the Club Facilities. All machines are to be used for what they are designed for and member agrees to only use machines for their intended purpose and design by the manufacture.

According, the Member(s) hereby (a) consents to voluntarily engage in much of the Club Activities as the Member may elect to engage in, from time to time, whether supervised or unsupervised, (b) consents to use the Club Facilities at the sole risk of the Member and with full knowledge of any and all risks associated with access to or the use of the Club Facilities or a participation in any of their Club Activities, and (c) assumes the full responsibility for any and all risks of bodily injury, illness, property damage, or other damage suffered by the Member resulting from access to or the use of the Club Facilities or a participation in any of the Club Activities. Further, the Member hereby (a) releases, waives, forever discharges, and covenants not to sue the Club, for any and all loss, cost, expense, damage, or claims, of whatever kind, character, or description, whether known or unknown, on account of, arising from, or relating in any way to any bodily injury, and or death, illness, conditions, property damage, or other damage resulting, in whole or in part, from access to or the use of the Club Facilities or a participation in any in any of the Club Activities, and (b) here by agrees to indemnify and hold the Club and any of its representatives harmless from and against any and all loss, cost, expense, damage, or claims, of whatever kind, character, or description, resulting , in whole or in part, from access to or the use of the Club Facilities or a participation in any of the Club Activities. Family members and any future family members release all rights as well based upon member(s) concent to utalize facilty and adhear to all terms presented and hold the Club harmless now and in the future as well as its representatives from and against any and all loss, cost, expense, damage, or claims, of whatever kind, character, or description, resulting , in whole or in part, from access to or the use of the Club Facilities or a participation in any of the Club Activities

Rules that MUST be followed upon club entry access and membership terms for Royse City Fitness LLC. ALL MEMBERS MUST CHECK IN as they are INTERING THE FACILITY, NO EXCEPTIONS!!!! If you have lost or deleted your QR entry code please call 972-635-2900 for us to send you a new QR code for membership check in. I can't find it anymore is not an excuse to violate this rule. It is a safety issue that is strictly inforced at all times and is required each and every time you enter the premises. Door codes are not sufficient and do not constitute as checking in. All standard club rules will apply such as dress code enforcement (athletic clothes at all times must be worn & tennis shoes, shirts must be worn at all times, no jeans or belt buckles on machines or benches!!!) Tennis shoes must be worn at all times with socks, no explicit language, safety at all times when using machines (do not use free weight benches without a spotter etc..), no unauthorized personal training (including but not limited to nutrition or meal plans or meal prep), no smoking or chewing tobacco and no illegal drugs of any kind in the facility or in the parking lot, no firearms on premise, machines are to be used for their actual function without deviation from manufactures design for the machine as posted on the machine, non members and minors under age 16 are NOT allowed on the gym floor for any reason (Minors are permitted in the children's facility during designated hours ONLY No Exceptions as well as the locker rooms with their legal parent or guardian only.) Teen members ages 16-17 must be accompanied by their parent or legal guardian during unattended staffed hours, same sex locker room usage only, racking weights after usage is required not just suggested, no heavy dropping weights on ground including dumbbells, wipe down machines after usage with spray bottle and rag or towel, no fighting, no gum or outside food permitted on gym floor, however drinks in closed containers are allowed on the gym floor, along with other standard gym rules etc.. Please read up on proper Gym etiquette if unfamiliar.  Royse city fitness is not responsible for any lost or stolen items anywhere on premise including parking lot. Please lock your car and belongings up to help prevent theft. Any and all damage to machines or facility cause by a member will to be charged to their account billing on file and or possible lawsuit for damages not collected including lawyer fees and court fees and any and all accosted cost involved to recover damages caused by member. Please note that door code entry is a privilege provided to members over the age of 18 and will be revoked if any of the following rules are broken and possible termination of membership: 1) Each member is to enter their own individual code in door to gain access (do not loan out your number or tell anyone else what it is or follow other members in.) Members are required to close the door completely immediately upon entry and leaving the facility without allowing anyone else access into the facility with the exception being their minor children who have memberships or are paying a guest fee for a guest during designated hours for guests and minors. All guests must be immediately checked in by a staff member upon entry. Each member is required to use there own code to enter and MUST scan membership card at check in desk as they enter the facility! No exceptions!!! We may access up to a $5 fine to your membership account for violators to who repeatedly do not check in per occurrence!!! If door code isn't working for another member do not open door for other member/ members for any reason!!!! If it is an emergency please use the land line phone and call 911 but to not allow entry. You may go outside on your own volition to render aid if you see fit. But please know we are not responsible. This will result in your membership being suspended, revoked or fined up to $50 per person you allow entry into the facility if it is intentional or not (if they are not members or have a past due account) Any minors you allowed entry will be assessed a $100 fee billed directly to your account on file. There is a reason they are blocked from entry and must press button on the door to speak to staff. This is not only a security issue it is also a liability issue and you freely concent that if they are injured you will be 100% responsible for sole liability of any and all injury or death claims awarded any and all lawyers fees and court cost not limited to any claims for mental or physical damages or injuries or lost wages.  Audio/ Video Cameras are in place and will be viewed at all times. If you are caught doing this your door code will be revoked and you will be forced to utilize the facility during staffed hours only and membership possibly terminated or fined!!!  Guests are not permitted during non staffed hours!!!! No exception, this includes minors or adults wanting to wait for you!!!! (They must remain in the parking lot and are not to enter the facility!!!) We do not allow bags or personal belongings on the floor, please keep them in the designated Locker rooms or on the door hooks of the designated closet or in your car. Do not block fire extinguishers with personal belongings. We do not allow personal equipment brought in to the facility (benches, bars, bands, steps etc... (Exception on personal idems such as weight belts, gloves, wrist straps etc.) Chalk is not permitted as it makes a mess. No video recordings for professional usage without prior permission. No video taping other members without their concent, this constitutes them being in the background of any of your videos. Tripods are not permitted and members are not to linger on equipment video recording or watching videos on their phones. This holds up machine usage for other members. Tanning, light therapys and the sauna pod as well as the children’s center are closed during non staffed hours and are not to be used for any reason.  Violations will result in your membership termination. Please schedule all tanning, light therapies, and the sauna pod appointments online and check in with a staff member upon each usage.  Please press button on front door if you need assistance. Thank you!  If a law is being broken or an emergency please call 911.  All guests must be signed in with an employee each and every time as soon as they enter the facility and are only permitted with employee approval. All guests must be over the age of 18 unless you are their legal parent or guardian. All minors must be accompanied with their legal parent or guardian!!! No exceptions. Minors ages 16 and 17 will only be allowed with out parent or guardian during staffed hours. (Staffed hours are posted on the door) Refunds will not be issued for any reason if membership is terminated due to non compliance to these rules and regulations. It is solely Royse City Fitness LLC's rights to terminate any and all memberships for any reason without prior notice and your immediate removal from the facility upon request. Termination of your right for facility usage will result without any sort of refund or reimbursment of funds for all memberships on your account and you acknowledge and agree to these terms. You willing concent Royse City Fitness to perform a background check and understand we reserve the right as a private organization to revoke your membership at any given time. 

*******PLEASE NOTE: Please allow us up to one business day for us to review your membership application for approval. Once approved and your enrollment fee is paid and we have received all payment information and documentation we will text you your membership check in card that will have a scanable QR code. All members are required to check in as they enter the facility. The scaner has a red lazer light next to the computer on the check in stand. We will also be texting you a personalized door code that is to be utalized ONLY by the primary member. All teen memberships will have to be signed up at the facility with staff durring staffed hours with minors parent or guardian present as aditional rules and restrictions apply to 16 & 17 year olds. you will recieve a short video clip of how the door lock works. Please feel free to come in during our staffed hours if it is your first time in the facility so someone can assit you if you are having any issues. We are staffed M- F 9AM to 8PM and Saturday 9AM to 2PM and on Sundays 1PM to 3PM
