  • THIS AGREEMENT, made by and between Shaffer Aviation, a Mississippi LLC (“SA”) and

  • Renter represents and warrants that the pilot in command of the Aircraft (herein the term Aircraft refers any and all of the aircrafts rented by Renter) meets all of the requirements of the FAR (Federal Aviation Regulations) including eligibility, endorsements, ratings, recency of experience for the type of aircraft being flown and the flight conditions under which flight will be conducted and holds a current FAA medical certificate; and

    That the aircraft being rented will be operated only for lawful purposes pursuant to Federal Aviation Regulations (FARs) and pursuant to SA policies.

    Aircraft Approved Usage

    All renters and/or CFIs must be approved by SA prior to use of the Aircraft.

    Prior to solo rental or rental for the purpose of passenger carrying, all new renters must complete and log an airplane-specific instructor-review by a SA designated CFI prior to first use and once per 10 hours of use.

    The AIRCRAFT may be used for flight instruction provided the instructor: holds a current and valid FAA CFI license and is eligible as an instructor under FAR 61.183, and is approved by Shaffer Aviation.

  • Student pilots must hold a valid student certificate, current FAA medical certificate, and a valid log endorsement from a CFI prior to solo flight.

  • PAYMENTS

  • The hourly rental charge for the aircraft, including fuel as measured on the Hobbs meter, are based on current rates. Payments may be made by check made out to Shaffer Aviation, 1308 Michael Circle, Tupelo, MS 38801 or paid using the SA webapp. Web payments will incur a 3% processing fee.

  • RESERVATIONS

  • Once approved, reservations are on a first to reserve basis using the SA reservation webapp. Every attempt will be made to honor reservations, but SA reserves the right to cancel reservations giving renter as much notice as possible.

    Prior approval is required for rentals that extend longer than 24 hours. Extended rentals may involve additional charges. SA will reimburse the Renter, in the form of a credit to Renter’s SA account, for required fuel purchases made away from (KTUP) up to the amount of concurrent self-serve rate at KTUP.

  • TRANSIENT MAINTENANCE

  • In the event a maintenance issue arises during Renter’s use of the aircraft, contact SA as soon as possible at 618.319.3420 and do not operate the aircraft unless you are authorized to do so by SA.

  • ADDITIONAL CHARGES

  • Renter shall be responsible for loss or damage to the aircraft, its components, parts or equipment and the amount of any fees associated with landing, parking, tie-down, ramp fees, hanger charges, costs of retrieval of the aircraft, including pilot cost and expenses. The Renter agrees to reimburse SA in the event suit is instituted by SA to recover possession of the aircraft; or to enforce any of the terms of this agreement or to collect any sum of money, damages, or cost including reasonable attorney’s fees incurred by SA in such a suit or suits.

  • PROHIBITED USES

  • The Renter agrees that rented aircraft shall not be used or operated: (a) For any illegal purposes.

  • (b) By any person other than the Renter who signed the agreement.

    (c) Outside the limits of the Continental U. S. unless prior permission from SA is obtained.

    (d) To carry passengers or property for compensation or hire.

    (e) For any flight for which the Renter is not properly rated or certified.

    (f) Any flight that does not comply with all FAR regulations.

    SA POLICIES: (Renter shall at all times comply with the following SA policies)

    Preflight – Renter will personally conduct a preflight inspection of the aircraft as recommended by the manufacturer using the manufacturer’s recommended check lists for pre-flight, start-up, takeoff, cruise and landing checklists. If oil is needed, notify the linesmen who will add the appropriate oil.

    Weather – Renter shall obtain a thorough pre-flight weather briefing, including NOTAMS relevant to each proposed flight. Renter shall plan to operate the aircraft only when the present and forecasted weather indicates VFR conditions local and enroute unless the Renter is instrument rated, current for IFR flight, the aircraft is equipped and current for IFR flight; and the Renter is specifically approved by SA for IFR flight.

    Physical conditions – Renter shall abide by all applicable FAA and Federal regulations pertaining to, and restricting the use of alcohol, narcotics, and sleep aids prior to flying.

    CARE of the AIRCRAFT – Renter will return the AIRCRAFT clean, free from debris, belts buckled across the seats, control lock installed, pitot covered, master switch off, key secured.

    Logging – Renter will carefully log each use using the SA webapp and notify SA of any observed issues or maintenance concerns with the AIRCRAFT.

    If in doubt about the condition of the AIRCRAFT, alert the FBO, do not operate the AIRCRAFT until authorized.

    In the event of an accident and/or a dispute arising out of Renter’s operation of the rented aircraft or the terms and conditions or performance of this agreement, the dispute shall be governed by the laws of Mississippi and any suit shall be brought in a state or federal court of competent jurisdiction within Lee County, Mississippi or the District of Mississippi.

    RENTER ACKNOWLEDGES THAT RENTER HAS READ AND UNDERSTANDS THE AGREEMENT ABOVE AS WELL AS THE RESTRICTIONS AND REQUIREMENTS OF THE RENTAL AGREEMENT AND ACKNOWLEDGES RECEIPT OF A COPY OF THIS AGREEMENT.
