  •  Acknowledgement and Assumption of Risk

    I have informed myself, understand, and am aware of the risks associated with participation in activities, including the possibility of injury or death. I have informed myself and understand the nature of these activities, my or my child's experience and capabilities and believe that I and/or my child is qualified, in good health, and in proper physical condition to participate in such Activities. I understand and acknowledge that the risk of injury and death exists in spite of all reasonable precautions that may be taken. By signing this form for myself (and my child), including the risk of injury and even death. 

     


    Waiver, Release, Discharge, Indemnity, Hold Harmless and Covenant Not to Sue

    I do hereby waive, release and discharge, for myself (and my child) and for all there is, executors and administrators, any and all rights and claims for damages for personal injury or death suffered by me (us) against the owner, operators, coaches, and other agents of Sharon's Wonderland Soft Play Equipment & Activities (Release) arising from or related to my (child's) participation in the activities at Sharon's Wonderland Soft Play Equipment & Activities; and I hereby, covenant not to sue and agree to indemnify and hold harmless all Releases from any all liabilities, claims, demands and causes of action for losses or damages arising from personal injuries or death that may be suffered now or in the future from my or my child's participation in the Activities. 

     


    Video/Photo Release

    Participants and/or their parents hereby permit the taking of photos, audio and video while using the facilities or programs at Sharon's Wonderland Soft Play Equipment & Activities for publication and use.

    Note- A retainer of $75.00, along with this contract, and a COVID-19 waiver must be completed and signed within 24 hours to reserve your event date, between the hours of 7am and 9pm.

    POLICY


    Retainers



    At the time of booking, a $75 retainer and also a signed contract will be required to secure your requested event date. Payments are made via Zelle. Remaining balance will be due (5 days) prior to your event. Failure to pay balance 5 days prior will result in cancellation of the event.

    *If booking is less than 2-3 days prior to the event date, the full amount will be due at the time of booking.

    Cancellations



    For any reason you need to reschedule/cancel your reservation, please be sure to contact us as soon as possible at the sharonwonderland@gmail.com. Cancellations are available with NO REFUNDS, but you are able to change your event date 5 days or more prior to the reservation date. Cancellations less than 5 days will automatically result in cancellation of your event with the loss of your retainer.


    Retainers are NON=Refundable. Unless Sharon's Wonderland Soft Play cancels your event.

    Weather Conditions



    If you are hosting an outdoor event you assume ALL weather-related risks. However, "BEFORE SET UP" if it should rain, we will work with you on a solution BEFORE setting up. If you are not able to hold your party indoors, you can check for another date.


    *Once Sharon's Wonderland Soft Play has COMPLETED the event set up and it begins to storm on your event. Unfortunately, we will have to pack up your event EARLY and you will not be able to check for another date or receive any type of refund!

    Outdoor Bookings



    If you need to setup at a park you will need to contact the park in advance to determine the requirements needed to setup. We are insured and can get a certificate needed. We require 7 day notice for certificate requests. For outdoor usage and outdoor set up will require a shaded area or a suitable cover in the form of a canopy tent, or pavilion, as the equipment will get hot in direct sunlight. Tents can be rented for an addition charge. A tarp will be provided, but please make sure the ground is flat, dry and clear from glass and debris. We do not set up on dirt. (photo of set up area must be provided)

    Set Up/Take Down



    Renter is responsible for clearing all areas needed for equipment and must be present at the time of delivery AND pick up. Please allow between 1 to 2 hours to set up and break down time depending on the package size. NO CONTACT/KIDS are allowed within 6ft of the set-up area during set up and break down due to maintaining social distancing.


    Please make sure we have a proper parking space to deliver and pick-up equipment to avoid any additional fees!


    *Additional fees may apply, if we deliver via stairs or to a venues located at long distances from the loading zone (including parks, large estates, or any location that presents delivery/pickup complications)!

    Equipment Cleaning Care



    To reduce the number of germs and therefore the spread of disease of illness we ask that you immediately disinfect any equipment that has come in contact with the following situations: Leaked soiled diapers, vomit, blood, or mucous. A disinfectant will be provided by Sharon's Wonderland Soft Play to ensure proper sterilization that is safe for all, including the equipment.

    Agreement

     

    This soft play equipment has been received in good condition and will be returned in the same condition.

     

    Customer agrees to allow Sharon's Wonderland Soft Play the right to enter premises of customer at any time to repossess said soft play equipment.

     

    Customer agrees to reimburse Sharon's Wonderland Soft Play for all attorney fees, an amount not less than 50% of all sums due, court cost and expenses incurred by Sharon's Wonderland Soft Play to enforce collection or to preserve or enforce rights under this contract.

     

    Customers agree not to loan, sublet or otherwise dispose of soft play equipment or use it at any other location.

     

    Customer agrees to pay in full the replacement cost, including labor, for all damages to soft play equipment.

     

    If the soft play equipment is lost, stolen, or damaged beyond repair, the renter agrees to pay up to $5000.00 (Five thousand dollars and 0 cents).

     

    Customer agrees to ensure that all users (and users’ guardians) of the rental go over and read all rules.

     

    THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED. The person/s or organization renting this Soft Play Equipment from Sharon's Wonderland Soft Play will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the conditions as above. I am aware that while in my care I am fully responsible for the soft play equipment and will pay for any loss or damages that may occur.

     

    Lessee understands and acknowledges that soft play entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing or colliding, emotional injury, paralysis, distress, damage or death to any participant. Lessee agrees to indemnify and hold Sharon's Wonderland Soft Play harmless from any and all claims, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the leased equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless Sharon's Wonderland Soft Play from injuries or damages incurred as a result of the use of the soft play equipment. Sharon's Wonderland Soft Play cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless Sharon's Wonderland Soft Play from any loss, damage, theft or destruction of the soft play equipment during the term of the rental and any extensions thereof.

  • Rules 



    It is the responsibility of the person/s or organization hiring Sharon's Wonderland Soft Play to ensure that all possible precautions are taken to avoid injury to people or damage to the soft play equipment. Please ensure the following safety instructions are followed: 


    1. NO food, drink or chewing gum on or around the soft play area. This will avoid any accidental risks and keep the equipment clean. (Please note if the equipment is collected in a dirty condition then the person hiring it will incur a cleaning charge.) 


    2. All shoes, jewelry, loose objects in pockets, and badges MUST be removed before entering the soft play area to avoid injury to peoples using the equipment and harm to the equipment. 


    3. NO face paints, party poppers, colored streamers, or silly string to be used either on or near the soft play area. (Please note these products will cause damage to the equipment that cannot be repaired.) 


    4. Sharon's Wonderland Soft Play is not responsible for striking or damaging any underground utility lines/devices (included but not limited to: electrical, plumbing, sprinkler, etc.). It is lessee’s responsibility to tell Sharon's Wonderland Soft Play where equipment is to be set up and have any underground utility lines marked prior too. 


    5.Climbing, hanging, or sitting on safety gates is dangerous and must not be allowed. 


    6. A responsible Adult must supervise the soft play equipment, at all   times. 


    7. Ensure children are not pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others.


    8. NO pets, outside toys, or any type sharp instruments in the soft play area at any time. 


    9. Please ensure that children are not attempting somersaults in the equipment area. 


    5. VALIDITY OF WAIVER. I understand and agree that if I institute, or anyone on my behalf institutes, any suit or action at law or any claim for damages or cause of action against any of Releases because of injury to my person or property, or my death, due to the activities covered by this Agreement, this Agreement can and will be used as evidence in court, and that agreements like this one have been upheld in courts in similar circumstances


    ACKNOWLEDGEMENT. I hereby acknowledge that I have read all of the provisions above and fully understand the terms and conditions expressed therein and agree to be bound by such terms and conditions. (required)
