RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Assumption of Risk
I understand that participation in Snowy Fun & Kidztalents activities involves physical movement, creative expression, and interaction with others. I confirm that the Participant is in good health and physically able to participate. If conditions become unsafe, the Participant agrees to stop immediately.

Acceptance of Risks and Responsibilities
I acknowledge that participation involves inherent risks, including but not limited to physical injury, emotional distress, illness, disability, or death (“Risks”). These Risks may arise from my actions, the actions of others, environmental conditions, or the negligence of Snowy Fun & Kidztalents and their representatives (“Released Parties”). I voluntarily assume all such Risks and accept full responsibility for any resulting loss, damage, or expense.

COVID-19 Acknowledgment
I understand the contagious nature of COVID-19 and voluntarily assume all risks related to exposure, illness, injury, or death. This includes any claims arising from the actions or negligence of Snowy Fun & Kidztalents, Kidztalents, or their representatives.

Release of Liability
I hereby release, waive, discharge, and agree not to sue Snowy Fun & Kidztalents, including their owners, employees, contractors, volunteers, sponsors, and affiliates (“Released Parties”), from any and all claims, demands, or causes of action arising from participation, including those resulting from negligence.

Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, damages, losses, or legal expenses arising out of participation by myself or the Participant, including claims brought by third parties.

Legal Costs and Jurisdiction
If legal action is required to enforce this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs. This Agreement shall be governed by and interpreted in accordance with the laws of the state in which Snowy Fun & Kidztalents operates.

PHOTO AND VIDEO RELEASE POLICY
Consent to Media Capture
By participating, I grant Snowy Fun & Kidztalents permission to photograph, record video or audio, and capture verbal statements of me or the Participant (“Likeness”).

Authorized Uses
I authorize Snowy Fun & Kidztalents to use the Participant’s Likeness for promotional and marketing purposes, including but not limited to:

Website
Social media platforms (Facebook, Instagram, YouTube, etc.)
Printed materials (flyers, brochures, newsletters)
Advertising and media broadcasts
Privacy Protection
Snowy Fun & Kidztalents will not disclose full names or personal identifying information without prior written consent.

Opt-Out Procedure
If I do not wish for the Participant’s Likeness to be used, I will:

Notify the event organizer or photographer at the event, and
Submit a written request along with a photo for identification.
Release Related to Media Use
Unless I opt out in writing, I release and hold harmless Snowy Fun & Kidztalents from any claims related to the use of the Participant’s Likeness.

Restrictions on Third-Party Use
No unaffiliated individual or organization may use, copy, or modify Snowy Fun & Kidztalents media without written permission.

ADDITIONAL PARENT/GUARDIAN CONSENTS
By signing below, I further acknowledge and agree that:

I am the parent or legal guardian of the Participant and have legal custody.
I agree to follow all guidelines, rules, and policies of Snowy Fun & Kidztalents.
Repeated misconduct by the Participant may result in suspension or expulsion.
I consent to my child being photographed or recorded for marketing and promotional purposes.
I permit my child to ride in vehicles related to program activities, provided an adult supervisor is present.
In the event of a medical emergency, I authorize Snowy Fun & Kidztalents to obtain medical treatment for my child.
I release Snowy Fun & Kidztalents from any and all liability for accidents or injuries occurring during organization-related activities.
If a chaperone or driver is required, I agree to fulfill that role if requested.

 

Parent Policy and Release Form

Please review our policies to ensure a safe and positive experience for all participants.

Registration & Health
All participants must have a completed registration and signed parent policy on file before attending.

Participants must be current on immunizations. If not enrolled in school, a health form and immunization record are required.

Attendance & Reservations
Please let us know if your child will not be attending on any specific day you've already booked.

State regulations limit attendance to five consecutive days.

What to Bring
Label all belongings with your child’s name.

No outside toys/electronics. We are not responsible for lost items.

Bring a nut-free food if you want to bring yours. 

If your child has food allergies, a signed Food Allergy Emergency Plan is required. Epi-pens must be provided if needed.

Illness Policy
Sick children cannot attend. They must be symptom-free for 24 hours to return.

No medications can be administered unless they are emergency-only (e.g., Epi-pen).

Parents must pick up ill children within 1 hour of notification.

Safety & Conduct
Children must wear socks in play areas.

Only authorized adults (with photo ID) may pick up children.

Behavior that endangers others may result in dismissal.

Parents must inform us of any special needs or behavior concerns in writing.

Staff are mandatory reporters and trained in CPR/First Aid.

Discipline
We use positive guidance techniques. Physical punishment is never permitted.

Frequent unsafe behavior may result in temporary suspension or termination of enrollment.

General Info
Staff cannot babysit outside of the program.

Emergency procedures are posted and practiced regularly.

Parents may visit with a staff escort during operating hours.

Photos/videos of participants may be used for promotional purposes unless you opt out in writing.

Medical Consent and Release

I authorize staff or my child’s sign-in representative to provide basic first aid if I cannot be reached. If further care is needed, I consent to emergency medical, dental, or surgical treatment as recommended by licensed health professionals. I allow my child to be transported by ambulance or staff if necessary.

I certify my child is in good health, with no undisclosed medical or contagious conditions. I waive my right to informed consent in an emergency and do not require a specific doctor or hospital to be contacted.

I understand childcare involves risks and agree to release Snowy Fun & Kidztalents, its staff, and affiliates from any claims for injury, except in cases of gross negligence or intentional harm. I accept full responsibility and acknowledge that I’ve had the opportunity to inspect the facility and ask questions.
