  • By accepting the terms and agreements at time of purchase, you (the "Client") acknowledge that you are voluntarily participating in coaching sessions, intuitive guidance, and/or training programs offered by Susan Gates (the "Coach") and Avoiding Average LLC (the "Company") and agreeing to the following terms:


    1) Coaching sessions and/or training programs may include activities and/or discussions that involve personal and sensitive information and may also include activities that involve risk of physical or emotional harm. By agreeing to these terms, the client agrees that they are aware of the risks and voluntarily assume those risks. The Coach and Company are not liable for any outcome or damages.


    2) The Coach and any other individuals or organizations associated with the coaching sessions and/or training programs are released and discharged from any and all claims, demands, or causes of action that the client may have for any injury or damage that is sustained as a result of participation in the coaching sessions and/or training programs.


    3) This release includes, but is not limited to, any claims based on negligence, action or inaction of the Coach or any other individuals or organizations associated with the coaching sessions and/or training programs.


    4) This release will be binding upon the Client's heirs, assigns, and personal representatives.


    5) Client is responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results. As such, the Client agrees that the Coach or Company is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services or products provided by the Coach and Company.


    6) Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.


    7) Client understands that coaching is not to be used as a substitute for professional advice by legal, mental, medical or other qualified professionals and will seek independent professional guidance for such matters. If Client is currently under the care of a mental health professional, the Coach will recommend that Client inform the mental health care provider.


    8) Client agrees to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the program. Client acknowledges that in order to see results, the client must do the work recommended by the Coach, and is not guaranteed results.


    9) The Coach agrees to maintain the ethics and standards of behavior set by the International Coach Federation (“ICF”) (www.coachfederation.org/ethics) and the Energy Medicine Professional Association ("EMPA").


    10) All notes and/or recordings will be kept strictly confidential unless given the express permission to share from the Client or where required by law.

    11) Payment must be received in full prior to scheduling the first session, unless monthly payment plan selected for packages. Failure to pay all installments on time will result in immediate termination of coaching relationship regardless of if paid sessions have been redeemed.

    12) Tardiness/No Show Policy: Client agrees to show up to scheduled appointments on time or to inform Coach of any delays via phone call, email, or text message. Any delays to start time will not be added to the end of the call or subsequent calls, unless it is due to the Coach being late. Coach agrees to wait for up to 10 minutes past scheduled start time before cancelling the appointment. No shows will be treated as a failure to cancel 24 hours in advance and will not be refunded or rescheduled.


    13) Cancellation Policy: To respect the time of all parties, all appointments must be cancelled at least 24 hours in advance of the scheduled start time in order to rebook an appointment. Failure to cancel 24 hours in advance will forfeit the call.


    14) Coaching Program inclusions:

     A) 3 & 6 Month Packages

    1. 12x 60 minute 1:1 virtual calls to be redeemed up to once per week

    2. Unlimited email/SMS support as needed

    3. 25% discount for any additional virtual calls (maximum of 3 discounted sessions)

    a. Discount will be based on cost of individual coaching sessions at time of package purchase and will not increase.

    b. Discount codes never expire.

    4. Worksheets and resources to aid in specific growth opportunities as deemed appropriate by coach

    5. Pre-recorded guided meditations as deemed appropriate by coach

    6. Intuitive readings, hypnotherapy, or akashic records readings as deemed appropriate by coach

     B) Soulo Pilgrimage Program

    1. 120 minute astrocartography review and planning session

    2. 2x 30 minute itinerary review meetings

    3. 60 minute pre-travel coaching session 

    4. 3x 60 minute coaching seessions while traveling

    5. 2x 60 minute coaching sessions post travel

    6. Unlimited email and voice note access while traveling. Responses will be provided between 8am and 6pm Eastern Time. 

    7. Travel planning and booking, plus any applicable Visa processing guidance 

    8. Travel itinerary preparation & travel guide with custom journal prompts for travel

    9. Intuitive readings, hypnotherapy, breathwork, or akashic records readings as deemed appropriate by coach

    10. Avoiding Average signature program workbook to be completed as needed

     
    15) Coaching Program and Packages Terms & Conditions:

    1. Email support will be available as needed in between calls weekly calls or if additional information is needed for weekly topic. Coach agrees to respond to emails within 24 hours, unless otherwise agreed upon.
    2. Additional coaching sessions purchased at a discount are limited to 3 for the 3 or 6 month program and 1 per month in the monthly plan. Discount codes and booking links will be provided after initial call. Discount codes are for the sole use of monthly clients, and Client agrees not to share or distribute the discount code to other parties.
    3. After the completion of the 3 month program, Client will have the option of
      1. Continuing coaching on the Month-to-Month plan in which recurring payments will be set up at the current monthly rate
      2. Hold their position on Coach's roster for $50/month to continue coaching when ready and avoid any future rate increases
      3. Discontinuing with no additional action required
    4. Cancellation of month-to-month plan must be received in writing to soulcoachsusan@gmail.com at least 30 days in advance of next billing cycle. For the purposes of the agreement, billing will be recurring on the same day of the month each month and will not be prorated (i.e. if agreement is signed on the 15th day of the month, recurring payment will occur on the 15th of the following month and coaching package inclusions will be available during that time).
    5. Refunds will not be issued for 3 month, 6 month, monthly coaching packages, or Soulo Pilgrimage regardless of if all sessions or check-ins are redeemed.
    6. The Coach reserves the right to be away for up to 2 weeks per quarter for vacation and will be communicated with Client ahead of time. If the package coincides with vacation time off, package will automatically be extended for total number of weeks missed due to vacation time off.
    7. Coaching packages of 3, 6, or 9 individual sessions never expire. Client will receive coupon code for redeeming sessions after purchase. Client agrees that session coupon codes are for their individual use and will not be distributed for use by anyone else. 
    8. Communication during travel will be responded to by the Coach as promptly as possible within the window of 8am through 6pm EST/EDT, unless otherwise agreed upon in writing. Any emergencies shall be managed using the emergency contact information in the Travel Guide. 
    9. While the Coach will provide astrological and intuitive guidance to support the Client's travel decisions, the Coach nor the Company make no guarantees or assurances regarding your travel experience, outcomes, or the conditions of any location you choose to visit. All travel decisions are made at your own discretion and risk.
    10. The Coach and the Company are not liable for any travel-related issues including, but not limited to, delays, cancellations, lost luggage, health concerns, accidents, weather events, natural disasters, civil unrest, visa denials, or changes in travel restrictions (such as those related to public health, immigration, or safety advisories).
    11. The Coach and Company will conduct due dilligence to select trustworthy third-party vendors for travel services, however they are not responsible for the actions or inactions, services, or policies of any third-party vendors.
    12. The Client assumes full responsibility for all travel-related risks and decisions outside of planned travel and activities provided by the Coach. This includes evaluating the safety, legality, and appropriateness of any location you may visit based on our services. You are encouraged to conduct your own research and consult with appropriate professionals (e.g., legal, medical, etc.) as needed.
    13. The Coach and Company strongly recommend purchasing comprehensive travel insurance, including coverage for trip cancellations, medical emergencies, and other travel disruptions. The Coach and Company will provide a quote for Travel Insurance on all travel packages. The Coach and Company are not responsible for any financial losses the Client may incur due to unforeseen travel issues.
    14. To the fullest extent permitted by applicable law, Avoiding Average LLC (and its affiliates, contractors, and representatives) shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your travel or use of our services related to travel.

    16) Client agrees that any and all worksheets, recordings, and documents provided to the client are the sole possession of the Coach and will not redistribute or sell in any format.

    17) Non-disparagement: Client agrees that the client shall not engage in any pattern of conduct that involves the making or publishing of written or oral statements or remarks (including, without limitation, the repetition or distribution of derogatory rumors, allegations, negative reports or comments) which are disparaging, deleterious or damaging to the integrity, reputation or good will of the Coach, its management, or of management of entities affiliated with the Coach.

    18) Except in the case of gross negligence or malpractice, I the Client or my representative(s) agree to fully release and hold harmless the Coach from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with my session(s).
