Client Portrait Agreement/Contract/Waiver & Copyright Acknowledgment
Copyright & Penalty Spoil U Photography retains all copyrights to all images created during client’s session. A print release will be included with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. magazines, etc), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Spoil U Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file. I understand it is ILLEGAL to copy or reproduce these photographs elsewhere without the PHOTOGRAPHER's permission, and violators of this Federal Law will be subject to its civil, criminal, and federal penalties. A limited PRINT RELEASE is supplied with the purchase of my session(s) digital files to print your portraits for your own personal use. The print release does not allow publication of your portraits (i.e. magazines, etc), selling or altering your images without the PHOTOGRAPHER's permission. Note from photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/facebook page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them.*

Exclusive Photographer: I have read and agree to the following statements: It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the session near the Photographer while they are working due to reasons of the photographer delivering the quality of images as expected and trip hazards. Any breach of this agreement (including iPhone, Droid, and Drone photography) can constitute a reason for non-completion of the job with no liability to the Photographer and no images released. "Behind the scenes" shots may be taken with the photographer's permission and at her discretion only.*

Non-Guarantee: Although every possible care will be taken to produce photographs of all important and special moments during the session, the Photographer cannot place an unconditional guarantee on the above. The Photographer will not be held responsible for any ruined photographs due to clients guests’ (or any other) flashes; or any other ruined photographs due to any other cause in or outside of the Photographer’s control. *

Payment(s), Payment Arrangements, & Refunds: I have read and agree to the following statements: Retainer(s) to hold date and time you the client have chosen, are due at booking. All payments are due in full 1 week prior to the session unless payment arrangements have been made. Payment arrangements will be stated in writing via electronic signature. Images will not be processed and/or prints will not be ordered until payment in full is received. Retainer(s) are non-refundable. Once a balance is paid, it is non-refundable. Refunds, Re-shoots, and Cancellations: I have read and agree to the following statements: Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, or by not following the recommendations of the photographer. The 50% retainer is not refundable. Shoots will be rescheduled at the discretion of the photographer for weather or illness. The monies paid are not refundable once images have been downloaded; be sure to download to a reliable source, Spoil U Photography is not responsible for your loss of images. Any other arrangements shall be discussed between the Clients and the Photographer.*

Penalty Fees & Charges: There is a $75 charge for payments returned by the bank for any reason. There will be a 20% payment fee for the remaining balance for any payments that are not postmarked or delivered to the Photographer by the required date. Rush orders there is a $250 additional fee. Major photo edits $25 per image or $450 per session fee. Travel fee varies. $450 per hr fees.*

Damages: Photographer is not responsible for the damage of Portraits, Prints, Products, USB’s, External Hard Drives or Discs after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits.*

Liability: Spoil U Photography, photographer, affiliates, and assistants are not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release the above mentioned from any claims against their person or their business. The Photographer takes the utmost care with respect to exposure, transportation, and processing the photographs including using professional grade equipment and professional grade backup equipment. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond the Photographer’s control, the Photographer cannot be held responsible. However we will find a suitable manner to “make it up” to the client as we see fit and fair. Although all care will be taken with all files created during session, Spoil U Photography cannot be held accountable it client wishes to have items purchased mailed or shipped. Nor can we be held accountable if and items are lost or stolen. Client takes such risk when ordering special delivery and not pick up. Further more Spoil U Photography is not responsible for any damage to clothing or persons that may or may not arise from the use of any animals, domestic or other, during any session. And it is the responsibility of the parent to be mindful of any persons under the age of 21.*

Co-operation of Guests: The Client is responsible for the conduct of their guests. The Photographer will not tolerate verbally or physically abusive behavior, nor will the Photographer share its time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography will seriously affect the quality of the photographs taken and increase the number of photos that must be created. If the Client is unable to control the conduct of their guests or if the conduct of any of their guests damages any of the equipment of the Photographer, it will result in the early or immediate departure of the Photographer. The Client understands that in such an event, no refund will be given. And the Client Will be liable for any costs in replacing or fixing damaged equipment. Both parties agree to cheerful co-operation and communication for the best possible result within the definition of this assignment. The Photographer is not responsible if key individuals fail to appear, fail to co-operate during photography sessions, or for failure to capture images due to details not revealed to the Photographer. So communication is very vital.*

Model Release: I have read and agree to the following statements: I commission Spoil U Photography, the photographer, to photograph myself and/or my underage children. I hereby grant Spoil U Photography and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of myself, family, and/or child(ren), or in which myself, family, and/or children will be included for editorial, trade, advertising, and any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. I hereby release Spoil U Photography and their legal representatives and assigns from all claims and liability relating to said photographs.*

For Pets: All vaccination must be up to date, and please have written documentation from your vet for our records. Keep a leash on your pet at all times, sometimes we can edit the leash and collar out but at an additional cost for a major edit. Please keep your pet under control at all times too. *

After 6 (six) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. Do you understand Spoil U Photography will not keep your images archived?*

Illness: In the event one of your family members or yourself is sick or running a fever, we ask that you reschedule your session. We have a child that is immune suppressed and we handle many children that are medically frail as well as preemie babies. So in everyone's best interest please reschedule. For GIVE AWAYS and FREEBIES, Limit for rescheduling is 2.*

NO GOING BACK for MISSED OPPORTUNITY: We know there are things we miss and we all wish we could go back and change. However, with Give Away's and FREEBIES it is NOT ALLOWED. If you are a Sports Team Entry, no reshoot dates are FREE*

Things to consider bringing to your Family Session:
- Bug Spray & Sunscreen.
- Extra outfit, because leaves get everywhere
- Blanket of your liking. Some photos maybe on the ground.
- Pet(s)
*NOTE: Please arrive to your session ready to go. We will not have time for makeup applications and in some cases we will not have time to do clothing changes either. If your Late more then 7 minutes your session is cancelled; if you do not confirm by text to Sarah at minimum the day before the session is auto-cancelled.
Retainers are due at booking, they are $75; they are non-refundable, but can be rescheduled within the next 2 months after the first session, however if your a no show or cancel less than 24 hrs of session then a new retainer will need to be paid.

Full payment is due 48 to 72 hours prior to the intended session. If weather makes it so that we are unable to proceed with our session, rescheduling arrangements will be made. If you are sick or have been around someone sick or arrive sickly your session will be rescheduled. We have an immunecompromised child and will not risk his health.
