  • ASSUMPTION OF RISK & RELEASE OF LIABILITY

  • I (the “Signor”, hereafter referred to as “I”, “Me”, “My”) understand and agree that the UC Fan into Flame Retreat (the “Event”) on February 7-9, 2025 held at Higher Ground Conference and Retreat Center (the “Venue”) and hosted by St. Paul’s Outreach, Inc. (the “Organization”), of which I am a participant, involves certain risks and that, regardless of the precautions taken by the Organization, such risks could result in physical injury, illness (including death), property damage, or economic loss.

    Specific risks or hazards may include, but are not limited to the following: any accident that occurs while driving to or from the Event, injuries that occur while engaged in activities or sessions during the Event, possible allergic reactions caused by food or insect bites, or any other such injury, loss, illness, or damage caused by the actions of a third party or another participant(s) at the Event.

    In consideration for being allowed to participate in the Event (the “Consideration”), I expressly and knowingly release the Organization and the Venue, as well as all of their officers, agents, representatives, advisors, directors, family members, volunteers, helpers, partners, organizational members, associates, and employees (collectively, the “Affiliates,” and when taken together with the Organization and the Venue, the “Sponsoring Parties”) from any and all claims and causes of action for property damage, personal injury, or death sustained by me that arises out of any travel, activity, or other related conduct by or under the auspices of the Sponsoring Parties, or caused by any risk associated with the Event and/or the negligence of the Sponsoring Parties.

    In addition, I understand and agree that the Organization and the Venue cannot be expected to control all of the risks articulated in this liability waiver or that may otherwise arise during the Event, but may need to respond to accidents and potential emergency situations. Therefore, I hereby give My consent to any medical treatment that may be required during the Event with the understanding that the cost of any such treatment will be My responsibility. I understand that the Organization and the Venue do not carry any form of medical or accident insurance for the Event, unless otherwise stated. Thus, I should review My personal insurance portfolio.

    I voluntarily and knowingly agree to defend, protect, hold harmless, and fully indemnify, the Sponsoring Parties against all claims, demands, or causes of action for property damage, personal injury, economic loss or death, arising from the negligence or fault of the above named, including defense costs and attorney fees arising out of My participation in the Event.

    Additionally, I agree to defend, protect, hold harmless and fully indemnify the Sponsoring Parties for any claim or cause of action whatsoever arising out of, or in connection with the Event, that is brought against any of the Sponsoring Parties by Me, whether such claim arises from the alleged negligence of the Sponsoring Parties, or from My negligence.

    If any provision, or portion thereof, of this agreement is held invalid or unenforceable under applicable law, then such provision, or portion thereof, shall be interpreted as narrowly as necessary or severed from the remainder of this agreement, but only to the extent necessary to render the remainder of this agreement or that provision valid and enforceable. The governing law for this agreement shall be the laws of Minnesota, without regard to conflicts of laws.

    I understand that this is a substance-free Event and agree not to bring and/or consume any form of illegal substance during the Event.

    I have read and agree to the above provisions and have willingly signed the same for the Consideration listed above and with a full understanding of this liability waiver’s purpose and legal implications.

  • EMPLOYEE & VOLUNTEER DRIVERS

  • This information pertains to both volunteers and employees who use their personal vehicles for SPO events and retreats.

    Automobile insurance follows the vehicle; therefore, the employee’s/volunteer’s auto liability insurance is primary.

    Under the No-Fault-Medical statute, if passengers are injured, the medical bills would go first to the passenger’s own automobile coverage, or if the passenger is a minor, to the parent/guardian’s autoinsurance. If the passenger has no auto coverage, then the medical bills would go to the volunteer driver’s No-Fault medical insurance. There is no medical coverage provided for employee/volunteer drivers or passengers in privately owned vehicles.

    Please be certain that your volunteer drivers have adequate insurance. The minimal acceptable liability limit from privately owned is $100,000/$300,000.
    All drivers must be at least 18 years of age, even if they are SPO employees.
    Drivers must have a valid driver’s license (non-probationary).
    Drivers must fill out a Driver Information Sheet to be kept on file in the SPO offices.
    Background checks must be performed for any employees/volunteers who will be driving minors.
    In addition, drivers should not have any physical disabilities that could in any way impair their ability to drive safely. The employee’s/volunteer’s vehicle should be in good working order and have current registration and license plates. It is advised, but not mandatory, that the employee/volunteer carry collision and comprehensive coverage on their vehicle as well, as SPO cannot pay for damages to their vehicle if it is damaged in a collision or is vandalized.

    If an SPO employee or volunteer, driving his/her personal vehicle for an SPO event, does not have the minimum amount of insurance coverage and is in an auto accident, that person will be held responsible for paying any claims made due to the accident, up to the limit of financial responsibility allowed by law in the respective state.

    Under no circumstances are 10-15 passenger vans (also known as conversion vans) to be used for SPO trips or to transport anyone for SPO activities. Regardless of who owns the vehicle, how many passengers are in the vehicle, or how many seats are installed in the vehicle, use of this van style is dangerous and strictly prohibited.
