The participant hereby:
1. Releases, discharges from liability, and covenants to indemnify and hold harmless BPC Management Zrt. and all of its owners, affiliates, officers, employees, contractors, consultants, sponsors, personnel, representatives and any other entities associated with any of the aforementioned (collectively, the “circuit”) against any claims howsoever arising out of and/or in connection with the Participant’s presence, including but not limited to: usage, driving, riding, racing, walking, running in the race track and/or all the surrounding facilities of the Balaton Park Circuit (collectively, the “Services”);
2. Waives all rights to claim for any and all liability, costs, expenses, demands, loss and/or damage of whatever nature arising from nervous shock, personal injury, damage to property, or death of the Participant, howsoever caused;
3. Agrees to indemnify the circuit for all costs (including legal costs), expenses, economic, loss (whether special or consequential, direct or indirect) that the circuit may incur due to any legal action brought by the Participant against the circuit caused by the negligence of the circuit or otherwise;
4. Declares to have examined the current condition of the circuit and of the technical support services available, including the applied safety measures, and to have ensured its efficiency and compliance with the requirements, and to therefore release the circuit in the widest possible manner, personally and on behalf of his successors or as participants in any way, from any consequence resulting from the planned activities, including incidents and/or accidents caused by the condition of the track, equipment and services;
5. Expressly warrants and represents that he has voluntarily agreed to participate and in so doing acknowledges the associated risks.
6. Declares to have thoroughly read and agree and commits to comply with the circuit’s published Rules of Operation.
7. The Participant further expressly agrees that this deed is governed by the laws of Hungary.
I, the undersigned, have read and voluntarily signed this Deed and agree that no oral representation, statements or inducements apart from the foregoing written deed have been made.
You understand that entering and being on a race track, using any vehicle is itself very risky and involves a high risk of injury and damage and by signing this document you confirm that you fully understand and are aware of and explicitly take this risk by your own decision.
