Mini Session Contract
Agreement: This Mini-Session Photography Contract (the "Contract") is entered into on {date} between Tania Ray Photography, hereinafter referred to as the "Photographer," and {name}, hereinafter referred to as the "Client," collectively referred to as the "Parties."
Scope of Photographic Services: 1.1 The Photographer agrees to provide portrait photography services to the Client during a mini-session on {date} at session location. 1.2 The mini-session is designed for [number of individuals, e.g., immediate family members or up to 5 people] and shall not exceed [duration, e.g., 30 minutes] in total.
Products Included and Payment: 2.1 The Client agrees to pay the total mini-session fee of $350 at the time of booking to secure the session date and time. 2.2 The mini-session package includes 3-5 high-resolution digital images. If client decides to further purchase, there is a minimum purchase amount of $750.
Booking, Rescheduling, and Cancellation: 3.1 The mini-session date and time will be confirmed upon receipt of the full payment from the Client. 3.2 The Client may request to reschedule the mini-session at least 7 days prior to the original session date, subject to the Photographer's availability. 3.3 In the event that the Client wishes to cancel the mini-session, the Client shall not be entitled to a refund of any payment made.
Late Arrivals & Weather Schedules: 4.1 The Client acknowledges that arriving late for the mini-session may result in a reduction of the session duration, and the session will end at the originally scheduled time. 4.2 In the event of inclement weather that prevents the mini-session from taking place, the Photographer and the Client shall work together to reschedule the session to a mutually agreed-upon date and time.
Styling and Props: 5.1 The Client is responsible for their own styling and outfit choices for the mini-session. 5.2 The Photographer may provide a limited selection of props for use during the mini-session, subject to availability and prior agreement with the Client.
Photographic Materials & Artistic Rights: 6.1 The Photographer retains all rights to the photographic materials, including but not limited to negatives, digital files, and proofs. 6.2 The Photographer will provide the Client with a curated gallery of edited images from the mini-session. The Client may choose their preferred images from this gallery for final delivery.
Additional Purchases: 7.1 The Client may have the option to purchase additional prints, products, or digital files beyond what is included in the mini-session package, subject to the Photographer's pricing and terms.
Cooperation: 8.1 The Client agrees to cooperate with the Photographer and follow any reasonable instructions to ensure the success of the mini-session.
Photography & Videography Restrictions: 9.1 The Client agrees not to engage in any photography or videography during the mini-session unless explicitly permitted by the Photographer.
Failure to Perform: 10.1 In the unlikely event that the Photographer is unable to perform their obligations under this Contract due to unforeseen circumstances, the Photographer's liability shall be limited to a refund of the mini-session fee paid by the Client.
Substitute Photographer: 11.1 In the event of unforeseen circumstances, the Photographer may appoint a substitute photographer to fulfill the obligations under this Contract. The substitute photographer will have comparable skills and expertise.
Indemnification & Liability: 12.1 The Client agrees to indemnify and hold the Photographer harmless against any claims, damages, or expenses arising from or related to the Client's participation in the mini-session.
Legal Miscellany: 13.1 This Contract represents the entire agreement between the Parties and supersedes any prior agreements or understandings. 13.2 This Contract shall be governed by and construed in accordance with the laws of Indiana. 13.3 Any modifications to this Contract must be made in writing and signed by both Parties.
