Apple iPad Tablet Use Agreement
The following Apple iPad Tablet Use Agreement (AGREEMENT) is made by and between Hiram College and {fullName}, hereinafter referred to as USER.
WHEREAS: In the interests of furthering the educational goals of Hiram and the USER, Hiram College will make available for use by the USER one (1) Apple iPad (TABLET) and accompanying accessories for use while the College participates in the Tech and Trek program.
THEREFORE: The USER agrees to the following terms of use.
1. DESCRIPTION OF EQUIPMENT PACKAGE
The USER will be provided with an equipment package under this agreement that includes but is not limited to:

Logitech Keyboard Case- $164.70
Apple Pencil (2nd Generation) - $119.00
Apple USB-C Power Adapter - $29.00
Apple USB-C Charge Cable (2m)- $19.00
2. TRANSFER OF OWNERSHIP OF EQUIPMENT PACKAGE
Hiram College guarantees to transfer full ownership of the iPad and accompanying accessories to USER upon completion and full payment of eight (8) Spring or Fall Traditional College semesters or upon graduation from the Traditional College. Software licensed by Hiram College will be reclaimed by Hiram College immediately upon transfer.
3. CARE OF EQUIPMENT PACKAGE
It is agreed and understood that the USER will exercise all due and reasonable care in the handling and use of said equipment package. USER agrees to voluntarily return all items in the equipment package in good condition immediately upon USER’s separation from Hiram College. Hiram College acknowledges that there will be reasonable and normal wear of these devices.
4. LOST OR STOLEN
a) iPad: In cases where the iPad is lost or stolen, a report must be filed with the appropriate law enforcement agency, the Hiram College Campus Safety Office, and the Dray Helpdesk within 48 hours of the time the iPad is lost or stolen. Failure to file a report of stolen property will cause the USER to be liable to Hiram College for the value of the missing iPad. A replacement iPad will not be issued until the report is filed.
b) The USER will be responsible for paying the cost of the lost or stolen iPad Pro and/or equipment package as identified in paragraph (1) above. This is a mandatory payment requirement. Upon this payment occurring, replacement equipment will be issued as appropriate.
5. LICENSE AGREEMENTS
Hiram College is the sole owner of the software included with the iPad. Any copying, modification, merging or distribution of the software by the USER, including the written documentation, is prohibited.
6. RULES OF IPAD OPERATION
The USER will act responsibly in order to protect the integrity of the Hiram College network and the privacy of other users.
a) USER accounts are for individual use only; under no circumstances should USER share password(s) or network access with anyone.
b) USER will acknowledge that the other accounts on the network are the private space of those individuals and their files are their personal property.
c) USER will return iPad to Dray Helpdesk as being notified by Dray Helpdesk via phone or e-mail.
d) USER agrees to comply with the Hiram College Acceptable Use Policy
7. TERMINATION OF AGREEMENT
Termination of this agreement shall occur automatically under the following circumstance:
a) Anytime the USER becomes separated or withdraws from Hiram College.
b) The time specified by this AGREEMENT expires.
c) Breach of the rules of this AGREEMENT or other Hiram College policies.
d) USER agrees to pay the full cost of the Equipment Package, OR voluntarily return all items in the equipment package in good condition using the return procedure cited in paragraph (9) below.
8. NOTICE OF HIRAM COLLEGE RIGHTS
a) The USER has no ownership, interest in, and no right to title in the iPad and/or accessories. Hiram College is the owner of the iPad Lease and as such, will enforce its rights vigorously through all means, civil and criminal, as Hiram College is responsible to abide by the terms of the lease agreement set forth by Apple. USER must return iPad and accessories to the Dray Helpdesk upon request by Hiram College. USERS who are in material breach of this agreement and/or who deny any of Hiram College’s lease ownership rights to the iPad and accessories will be prosecuted for felony theft. USERS who deny Hiram College ownership rights will also be pursued through a civil action for collection. If collection is necessary, the cost of the iPad and accessories, in addition to interest penalties, collection cost, and legal fees, may be assessed. Notice of these civil and criminal remedies will be sent to any USER in violation of this agreement prior to action being taken.
b) USER, by signing this agreement, authorizes Hiram College to add any unpaid cost and fees to the User Student Account.
9. RETURN PROCEDURE FOR IPAD EQUIPMENT PACKAGE
USER shall call or email the Dray Helpdesk (330)-569-5313 or helpdesk@hiram.edu) to coordinate the return of iPad equipment.
10. INDEMNIFICATION: USER agrees to reimburse and hold Hiram College harmless from and against any and all liabilities, cost, and damages [including attorney fees], which arise out of or relate in any way to the use or misuse of the iPad equipment or software by USER or others.
The USER agrees to return the iPad and all equipment/accessories described in paragraph (1) to the Dray Helpdesk no later than three (3) business days upon the end of your enrollment at Hiram College and/or upon notification from Hiram’s Dray Helpdesk.
DELIVERY AND ACCEPTANCE: By providing a signature on this form the USER agrees to receive and accept the equipment package and accessories via mail delivery with signature confirmation. USER’s signature confirmation and acceptance of the equipment package acknowledges receipt of the iPad, and peripheral equipment and software listed above, in good condition and working order. USER agrees to setup the device using the credentials provided them by Hiram College, thereby linking the device to the Hiram College Mobile Device Management (MDM) software and allowing Hiram College to verify the service tag associated with the iPad. In the event of separation of the USER from Hiram College, the iPad, and all associated equipment listed, must be returned to Hiram College Dray Helpdesk prior to the time of separation. Failure of USER to return the iPad at this time will result a hold placed on any remaining paychecks and the replacement value of the iPad and accessories will be billed to the USER. Civil and criminal penalties may also be pursued by the Hiram College.
A copy of this signed document will be maintained electronically by Hiram College.
