WAIVER & RELEASE:
You, Buyer and Student, agree that you are aware that Student is engaging in physical exercise, and the use of equipment, use of the School’s facilities, training and instruction, and on all field trips which can be dangerous and cause harm to the Student. Student is voluntarily participating in these activities and Buyer and Student assume all risks of injury to Student, which may result. Buyer and Student hereby waive and release any claim or right to sue employees, agents or instructors of The Center for Martial Arts Excellence for injury to Student on any field trip or on School property. Buyer and Student have carefully read this waiver and release, and fully understand it is a release of all liability and damage of the School for any injury. The Center for Martial Arts Excellence will make no evaluation or recommendation whether Student or guests are sufficiently, physically fit for any exercise activities. It is always advisable to consult your physician before undertaking a physical exercise program, particularly Tang Soo Do activities.
Medical Release:
The student or parent/legal guardian of student represents and warrants that the student is physically fit and has no medical conditions, preexisting or otherwise, that would limit them from participating in any capacity in the school’s training program. In the event that emergency medical treatment is called for, student or parent/legal guardian authorizes transportation and licensed medical personnel to perform accepted medical procedures, and agrees to bear the expense of any such transportation and/or services.
Physical Contact:
The student or parent/legal guardian of student understands that during the course of martial arts instruction provided by school that physical contact between students, instructors, other persons and inanimate objects (targets, training equipment, etc.) will occur. While reasonable precautions to avoid injury are taken, injuries may occur. The student or parent/legal guardian of student is aware of the risks of such contact.
Protective Equipment:
The student understands and agrees to observe all training rules and regulations of school which include the use of specific protective equipment approved and purchases through the school. Protective equipment, required by the school, will largely eliminate the possibility of accident or injury; however, school does not warrant protective equipment of any kind and the student acknowledges the potential for bodily injury even with the use of protective equipment. Student understands it is his or her responsibility to purchase protective equipment through school.
Release of Liability and Assumption of Risk:
The student or parent/legal guardian freely and voluntarily agrees on behalf of student and his/her heirs, personal representatives, executors, administrators, agents and assigns to assume all risks of their decision to participate in this training program and agrees to be responsible for their own welfare. Student accepts any and all risks of delay. Unanticipated events, disease, or illness, injury, emotional trauma, and death associated with their training program at The Center for Martial Arts Excellence. Student agrees to hold the school, its owners, employees, and other students harmless, and waives any rights for claims for injury, disease or illness, sexual harassment, demands, obligations, actions, causes of actions, losses or expenses of any nature whatsoever associated with Tennessee Tang Soo Do. Student intends his/her initials below to be a complete and unconditional release of liability to the greatest extend allowed by law and verifies this statement. Student/Parent/Legal
Photo, Video and Audio Release:
The student or parent/legal guardian of student agrees that School may take photographs, make videos, or make audio recordings of the student or parent/legal guardian, classes, and school events in which the student may be present. Student or parent/legal guardian of student understands these materials may be used for display, promotions, or advertising or sold for profit and hereby waives any right to or compensation for appearing in such materials. Loss/Damage/Theft of Property: School does not assume any responsibility for the loss, damage, or theft of any property belonging to the student. Student agrees that the school and its personnel are not responsible for or liable for any such property, even if its loss, damage, or theft occurs on or about the school’s facility.
No Refund Policy:
Student shall not be entitled to a refund for any amount paid to the school or its designees pursuant to this Agreement. Should student choose to pay this agreement in full, be aware that you are paying for future services and may be risking loss of your money in the event that School ceases to conduct business.
Agreement to Follow Rules and Regulations:
Student agrees to follow school rules as promulgated from time to time. Violations of these rules and regulations may result in suspension or cancellation of membership without reimbursement for any and all fees and tuition paid to the school. If student has been given due warning by the school of failure to comply with school rules and regulations, suspension or demotion from current programs without cancellation or reduction of fees may and/or would apply to the duration of this agreement.
Transportation Waiver:
As students/parent, and/or parent of the child listed above give my permission for my child(ren) to be transported by the employees of The Center for Martial Arts Excellence. I hearby release The Center for Martial Arts Excellence, its agents, employees, owners, and trustees, of any and all liability arising out of his/her transportation on company vehicles to or from The Center for Martial Arts Excellence in conjunction with my child's participation with programs at The Center for Martial Arts Excellence.
Loss/Theft/Damage or Property:
School does not assume any responsibility for the loss, theft, or damage of any property belonging to the student. Student agrees that the school and its personnel are not responsible for or liable for any such property even if its loss, damage, or theft occurs on or about the school's facility.
