Bareboat Charter Agreement - MIAMI JETCAR LLC
  • This Bareboat Charter Agreement made between Jean Codada hereinafter called "OWNER" and the so-called "CHARTERER" (Renter)

  • 1. OWNER hereby agrees to let and demise bareboat, and the CHARTERER agrees to hire on a bareboat basis upon the terms and conditions and for the consideration hereinafter set forth the said Vessel for a period commencing on and ending on

    2. The vessel shall be delivered to CHARTERER in good seaworthy condition and shall comply with all applicable laws and regulations pertaining to the condition of the Vessel.

    3. CHARTERER shall maintain Vessel in good order and condition, reasonable wear and tear excepted. CHARTERER shall not be responsible for repairs to Vessel except to the extent that need for such repairs arises from negligence or willful misconduct of CHARTERER, its officers, agents, employees, students, invitees, or guests. OWNER agrees to furnish any necessary maintenance materials needed by CHARTERER in order for CHARTERER to fulfill its obligation to maintain the vessel in good order and condition. OWNER agrees to make any repair needed to keep Vessel in good seaworthy conditions and in compliance with all applicable laws and regulations to the extent the need for such repair does not arise from negligence or willful misconduct of CHARTERER, its officer, agents, employees, invitees, or guest. The vessel shall be subject to inspection at any reasonable time by OWNER or its agent or employee provided OWNER has furnished reasonable advance written notice to CHARTERER of its intent to make such inspection.

  • 4. CHARTERER warrants that the skipper hired by CHARTERER will be a qualified and competent person, who shall be the employee of the CHARTERER, and be responsible for the safe navigation of the Vessel.

    5. Charterer warrants that the Owner/Captain/Manager or any other designated by OWNER has verified the qualifications, experience and suitability of the Charterer and has properly instruct them on the handling of the Vessel including but not limited to the use of the "Emergency Manual" before handing the Vessel over to the Charterer.

    6. CHARTERER expressly agrees that the operation of said Vessel will be limited to the following areas and waters: INTERCOASTAL MIAMI

    "CHARTERER further agrees that the operation of the said Vessel be limited to any areas in waters specifies in any insurance policy provided pursuant to paragraph 6, and any insurance policy which has been disclosed to CHARTERER prior to execution of this Agreement".

    7. CHARTERER is not obligated to provide insurance vessel has charter insurance and liability insurance CHARTERER shall indemnify, defend and hold harmless OWNER, its officer, agents, and employees from and against any claims, damages, expenses or liabilities arising out of the performance of this Agreement or the use of said Vessel including without limitation, claims, damages, expenses or liabilities for loss or damage to any property, or from death or injury of any person or persons, in proportion to and to the extent such claims, damages, expenses, or liabilities arise from the negligence or willful misconduct of CHARTERER, its officers, agents, or employees.

    8. CHARTERER agrees that the Vessel shall be employed exclusively as a training and pleasure of the vessel for the sole and proper use of itself, and guest, during the term of this Charter. CHARTERER further agrees not to transport MERCHANDISE FOR HIRE or CARRY PASSENGERS FOR HIRE, or engage in any trade, or in any way violate any laws of the United States or of any other government within the jurisdiction of which the Vessel may be at any time during the Charter.

    9. CHARTERER shall have no rights, power, or authority to create, incur, or permit to be imposed upon the Vessel any liens or encumbrances of any nature. A fully executed copy of this Charter Agreement shall be always carried aboard the Vessel with the ship's papers during the term of the Charter and shall be exhibited by CHARTERER to any person having business with the Vessel which might give rise to any lien CHARTERER shall redeliver said Vessel free from any liens incurred as a result of the operation of the Vessel under this Charter Agreement and shall indemnify and hold harmless OWNER or its agents against any lien not incurred by OWNER or covered by insurance arising out of the possession, use, or operation of said Vessel or by any persons aboard said Vessel by invitation of CHARTERER.

    10. CHARTERER shall not sub-charter or assign this Charter without obtaining the consent of OWNER in writing. If at any time CHARTERER fails to remedy any default with respect to any of the provisions, covenants, or conditions of this Charter to be kept or performed by CHARTERER within days after notice thereof, or such additional time as is reasonably required to cure such default OWNER shall have the right to terminate this Charter by giving written notice if such termination to CHARTERER.

  • 11. OWNER shall not be responsible for failure to deliver the Vessel at commencement of the Charter if such failure is caused by reasons beyond the control of OWNER or by reason of said Vessel having been lost or disabled. Should such delivery not be made within one day after specified date, this Agreement may be canceled by CHARTERED and any deposits or amounts heretofore paid on charter hire shall be returned by OWNER to CHARTERER.

    12. REFUNDS: The deposit is NOT refundable. The OWNER, in its sole discretion would reschedule your trip if it determined that it is unsafe to use the vessel, or if it is raining nonstop, or if there are any other dangerous conditions, that will make the use and operation of the vessel, unsafe for the crew, the passengers and the vessel. The determination of such circumstances is in the OWNER, Captain or Crew sole's discretion. In case that the OWNER agrees to reschedule the trip, CHARTERER will have one year, from the day of the original trip to schedule the same.

    13. ARRIVALS: The time will start counting at the beginning at the scheduled time. If CHARTERER arrives late to the scheduled appointment, the time would get discounted from the trip total.

  • ALWAYS follow the captain's instructions, it's for your safety. Adults must always accompany children. Kids 7 years old or younger must wear a lifejacket at ALL TIMES. NO diving. NO Smoking. Weapons and Burners are NOT allowed in the boat. Drugs and RED Wine are NOT allowed in the boat. Do NOT stand on the boat platform when the boal is in movement, platform access door must be stay closed at all time Do NOT throw, by any reason, trash or any items to the water, MIAMI JETCAR LLC is compromised with maintaining our waters clean. If you throw any trash into the water, we will stop the trip until we clean it up and the time will be deducted from your trip.

  • 1. I wish to participate as a guest on the bareboat charter boat ride (the "Boat Ride"), being operated by "CHARTERER" and I acknowledge that my participation in the Boat Ride is completely voluntary.

    2. I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH BOATING, including, but no limited to equipment failure, perils of the sea, harm caused by other vessels, acts of fellow participants, entering and exiting the water, boarding or disembarking boats, and activities on board of the vessel.

    3. I fully assume responsibility for my own safety (including, without limitation, following all directions of the boat's captain and crew) while participating in the Boat Ride, and verify that I am physically able to participate.

    4. Having read this waiver, I agree to RELEASE from LIABILITY and HOLD HARMLESS, MIAMI JETCAR LLC, along with its respective officers, directors, employees, owners, members, managers, affiliates, agents, representatives, attorneys, heirs, personal representatives, successors and assigns, all individuals associated with the Boat Ride, and all individuals and entities having an interest in the boat being used for the Boat Ride, from any and all liability, claims, demands, equitable relief, damages, costs, expenses, and causes of action of any kind or character of any type or nature whatsoever (including negligence), arising out of the Boat Ride.

    5. I authorize MIAMI JETCAR LLC to use any photographs or audio and video recording of my participation in the Boat Ride for any and all purposes

    6. I certify that I have read this document and agree with its contents.

  • 7. I authorize "my child" to participate as a guest on the bareboat charter boat ride (the "Boat Ride") being operated by "CHARTERER" and I acknowledge that my child's participation in the Boat Ride is completely voluntary.
