I hereby agree to the following:
1. That I am participating in the Health & Fitness Classes, Programs or Workshops offered by Taylor Jackson and/or Evergreen Performance during which I will receive information and instruction about health and fitness. I recognize that fitness programs require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Health & Fitness Classes, Programs or Workshops. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in the Exercise Classes, Health Programs or Workshops.
3. In consideration of being permitted to participate in Health & Fitness Classes, Programs or Workshops, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the program.
4. In consideration of being permitted to participate in Health & Fitness Classes, Programs or Workshops, I knowingly, voluntarily and expressly waive any claim I may have against Taylor Jackson and/or Evergreen Performance for injury or damages that I may sustain as a result of participating in the program.
5. I, my heirs or legal representatives forever release waive, discharge and covenant not to sue Taylor Jackson and/or Evergreen Perfomance for any injury or death caused by their negligence or other acts.
6. Cancellation Policies
A. 24 *Business* Hour Cancellation Policy
PERSONAL TRAINING CLIENTS understand that a minimum of 24 business hours is required to cancel or reschedule a training session. If fewer than 24 business hours notice is provided, the client forgoes and loses the training session in question.
e.g. If the training session in question follows a holiday or weekend, the holiday/weekend days do not count toward the 24 hour timeframe for adequate notice.
B. Recurring Session Cancellation Policy
PERSONAL TRAINING CLIENTS understand that written (email or text) notification of a change or cancellation in a recurring training session is needed and that verbal communication of the change will not suffice.
7. "Use It or Lose It" Policy:
A. SMALL GROUP & TEAM TRAINING CLIENTS understand that sessions purchased for a specific training program or training phase can only be used for that training program or training phase and cannot be transfered or used for a different training program or training phase.
B. PERSONAL TRAINING CLIENTS understand that all training packages expire 12 months after the date of purchase.
I have read the above release, waiver of liability and training agreement and fully understand its contents. I voluntarily agree to the terms and conditions stated above.
