I, the undersigned participant, acknowledge and agree to the following as a condition of my participation in this martial arts tournament:
1. Assumption of Risk and Release of Liability
I fully understand that participation in martial arts competitions involves inherent risks, including but not limited to bodily injury, disability, and, in rare cases, death. I voluntarily assume all risks associated with my participation in this event.
I hereby release, discharge, and hold harmless the City of Orlando, FL, Wah Lum Kung Fu Temple, Inc., tournament organizers, event officials, instructors, referees, staff, volunteers, sponsors, and any other associated parties (collectively referred to as "Released Parties") from any and all claims, liabilities, damages, medical expenses, or losses arising out of or related to my participation or attendance at this event. This release applies to claims of negligence, but not to claims of gross negligence or intentional misconduct.
2. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or liabilities, including legal fees, arising from my actions, conduct, or participation in this event.
3. Media Release and Compensation Waiver
I grant permission for event organizers and associated parties to capture and use my image, likeness, and voice in photographs, video recordings, media coverage, and promotional materials related to this event. I waive any right to compensation for such use now and in the future.
4. Compliance with Rules and Regulations
I acknowledge that martial arts competition involves physical contact and agree to abide by all tournament rules, regulations, and the instructions of officials. I accept full responsibility for any consequences resulting from the violation of such rules.
5. Medical Treatment Authorization
I certify that I am in good physical and mental health and have no medical conditions that would impair my ability to participate safely. In the event of a medical emergency, I authorize event officials or emergency personnel to provide necessary medical treatment, including transportation to a medical facility. I understand that I am responsible for all medical expenses incurred.
6. Arbitration Agreement
I agree that any disputes or claims arising out of or related to this waiver, my participation in the event, or any interactions with the Released Parties shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. I waive my right to a trial by jury or to participate in a class action lawsuit.
7. Severability Clause
If any provision of this waiver is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
8. Social Media and Online Posting
Wah Lum forms will be performed in their traditional state; as such, we respectfully request the preservation of our style by keeping all forms and weapons forms private. Any video recordings taken may not be shared online in their entirety without prior written consent from Wah Lum Kung Fu Tmeple, Inc.; brief excerpts up to 15 seconds in length may be shared for promotional or educational purposes with appropriate credit. Posting photos is permitted, but full recordings of any form or weapons form are not allowed.
9. Acknowledgment of Understanding
I have read this waiver in its entirety and fully understand its terms. I acknowledge that I am signing this agreement voluntarily and that, by doing so, I am giving up certain legal rights. I further acknowledge that this is a legally binding contract, and that my digital signature is the same as my handwritten signature and will carry the same legal effect.
