Waiver

Please check the following statements indicating your agreement with them. If you are unable or unwilling to agree to all of the statements, you will not be granted membership in the Whitney Fitness Center and will not be allowed to use the fitness equipment.

I am age 55 or older.I understand that strength, flexibility and aerobic exercise, including the use of equipment, is a potentially hazardous activity. I understand that fitness activities involved risk of injury and even death, and I am voluntarily participating in these activities and using equipment and machines with knowledge of the dangers involved.I have either attended a free Fitness Center orientation session about the safe use of fitness equipment, or I agree to attend one before using the equipment.I declare myself to be physically sound and suffering from no condition (including but not limited to heart trouble, pains in my chest, fainting or dizziness, and bone or joint problems) that would prevent my participation in fitness activities. I have been informed of the need for physician's approval for my participation I fitness activities, and a yearly or more frequent physical examination to confirm ongoing readiness for fitness activities.By accessing, using, or viewing virtual fitness offerings you are agreeing to Whitney Senior Center's Terms of Use and Liability Waiver. To make virtual fitness classes as freely accessible as possible to our members, and any other participants, we will be using this statement as a warning and assumption of risk. Participation in virtual group fitness classes offered by Whitney Senior Center is voluntary and at your own risk. In participating in virtual fitness classes I am acknowledging that I am physically able to participate and I am not aware of any condition that would limit my participation. Participants are encouraged to stop if they experience pain or injury and should seek appropriate medical advice or care as needed.By signing this sheet, I hereby release, indemnify, and hold harmless the City of St. Cloud, its officers, agents, and employees, including those of the Whitney Senior Center, from any and all damages, claims and causes of action whatsoever for any loss or injury suffered by me by reason of my participation in the Whitney Senior Center Fitness Club and use of its fitness equipment.
