By and Between:

Katie and Jason Yahnke (The "Owners")

AND

The Agreement is in relation to the following Boat:

2013 Bennington 20' Pontoon Boat,
Hereinafter referred to as ("Boat")

The Owners and Renter agree to the following terms and conditions in regard to the renting of the Boat:

1. Rental Period
   The boat shall be rented on these dates:

2. Rental Payment Details

4 Hours: $250   Full Day (up to 9 Hours): $425.00 per day
Security Deposit: $250.00 (Security Deposit will be returned within 14 Days of Return Date of Boat as long as there are no damages and gas tank is full upon return.)

3. Boat Usage Terms:

The Renter Agrees to the following terms in regards to the Boat:

1. The Boat shall be operated in a safe and lawful manner.   

2. The Boat shall not be operated by any person except the Renter without written permission by the Owners.

3. The Renter shall not remove or tamper with any of the Boat Equipment.

4. The Boat shall not be used to participate in any race, competition or stunts.

 5. The Boat shall at no time have more passengers than the maximum of 10 people.

 6. The Boat shall not at any time be used for any illegal purpose.

7. The Boat shall not have alcohol on the boat, nor shall the drivers or passenger be under any alcoholic influence while on the Boat.

8. The Boat shall not be used to tow any other boat, or object.

9. The Boat hours of rental are from 8AM until 7PM. The Boat MUST be returned before 7PM. There is absolutely no operating the Boat once it is dark.

10. The Boat is located at The Dirty Turtle Marina in New Lisbon, WI at Dock 3 Slip 9. The Boat must be properly tied up.

11. ALL Garbage and personal Items Must be removed from Boat.

12. The Boat MUST be cleaned and returned in same condition as received

13. Premium Gas Only (NO ETHYNOL). Tank Must be filled upon Returning. If not returned with a full tank, there is a $50 fee.
There is a gas tank located by the Dirty Turtle Restaurant.

14. Drive MUST abide by NO WAKE zone. Be respectful of all other boats. Any damage to anyone else's property is Renters responsibility.

15. If Boat has any problems or breaks down while in use by The Renter, it is The Renter's Responsibility to tow the Boat back to the dock located at The Dirty Turtle Dock 3 Slip 9.

16. The Lessor is NOT Responsible for Any injuries.

17. The Renter of the boat is born before 1989 or has their boater's license. Proof of Boaters license has been given to Lessor.

 WAIVER OF LIABILITY

We, {renterName} agree to rent a 2013 Bennington 20-foot pontoon boat from Jason and Katie Yahnke. We, as renters, do hereby assume all risks of and responsibility and liability, for all losses, damages, personal injuries and/or damage to property, incurred by us or any other person during our use and occupancy of the boat, regardless of whether they are caused by our use and occupancy thereof. In addition, we agree to be liable for any damaged caused to the above-referenced boat during the rental period of the boat.

 

We agree to release, indemnify and hold Jason and Katie Yahnke harmless from all losses, injuries, claims, actions, suits, proceedings, death, costs, expenses, damages and liabilities, including attorneys' fees, arising out of, connected with, or resulting, directly or indirectly, from or during our use of the above-referenced boat. We shall defend, at our expense, all suits brought against Jason and Katie Yahnke, either alone or in conjunction with others, upon any such liabilities or claims, and shall promptly satisfy, pay and discharge all judgments and fines recovered against Jason and Katie Yahnke in all such actions. The Renter is using boat at Their OWN RISK.

 

The Parties hereby indicate by their signatures below that they have read and agree with the terms and conditions of this Agreement in its entirety.
