YAWGOO VALLEY WATER PARK RELEASE AND ACKNOWLEDGMENT OF RISK
THIS IS A CONTRACT – PLEASE READ BEFORE SIGNING
Terms of Purchase and/or Participation:
I, ______________________or my legal guardian, agree to freely and expressly assume and accept the responsibility for any and all risks associated with the use of Yawgoo Valley Water Park. In consideration of the above and for being allowed to use the facilities of Yawgoo Valley Water Park, I or my legal guardian, agree to RELEASE Yawgoo Valley Water Park and its representatives from liability for all claims for personal injury to person or property. I or my legal guardian, further agree to HOLD HARMLESS Yawgoo Valley Water Park for any loss, liability or damage myself or those I am signing for may incur as a result of any injury to myself or anyone for whom this agreement is signed. I or my legal guardian agree that RHODE ISLAND LAW shall govern any and all disputes between myself/my legal guardian & Yawgoo Valley Water Park regarding any alleged incident and EXECUTIVE JURISDICTION shall be in the State or Federal Court of the State of Rhode Island.
By entering this property, I agree to comply with all resort policies. Management reserves the right to determine the occurrence of trespassing or any other misconduct as well as involve any necessary law enforcement for the safety and security of its customers, employees, facilities, & equipment. Resort management reserves the right to close the resort due to inclement weather or hazardous conditions without notice.
Entrance is revocable by management if myself, or those I am signing for engages in improper conduct or commits an act which may endanger myself, themselves, or others. Entrance tickets, or wristbands have no cash value and may not be resold or transferred.
HEIGHT AND WEIGHT RECOMENDATIONS – 48 INCHES AND 175 POUNDS
The manufacturer recommends a minimum height of 48 inches. Participation of riders below that height is not recommended. Our slides drop into a 3-foot splash pool and a user weight limit of 175 pounds is recommended due to the increase in speed with weight, and the accompanying increase of risk of injury. Participation of riders above that weight limit is not recommended.
Riders are expected to abide by these recommendations. Those who do not meet the height recommendation, and those who exceed the weight recommendation, use the slide at their own risk.
GENERAL PARK RULES:
· A Ticket IS REQUIRED FOR EVERY GUEST Entering the gated pool area, And Every ticket Holder Assumes All Risks and Liability.
· We Do Not Discount, Refund, Or Issue Credits Should You Miss A Portion of Your Reserved Session, Or If You Cannot Attend Your Reserved Session.
· Swim & Slide At Your Own Risk.
· No Smoking Or Illegal Substances.
· No Animals Or Pets Except For Service Animals As Defined By The ADA.
· No One Should Swim Alone.
· No Coolers, Outside Food, Alcohol or, Drinks, Grills, Tents, Pinatas Allowed.
· No One Under The Age Of 18 Permitted Unless Accompanied By An Adult.
· ALL Children And Any Non-Swimmers Must Be Within Guardian Reach AT ALL TIMES.
· We Are Not Responsible For Lost, Stolen, Or Damaged Belongings.
· No Person With or Suspected of Having a Communicable Disease Which Could Be Transmitted Through the Use of the Pool, open lesion, blister, rash, or cut Shall be permitted from pool use
· Any Person Who Currently Has Or Has Had Diarrhea Within The Prior Two Weeks Is Prohibited from Entering the Facility.
· Spitting, Spouting Water From The Mouth, Or Blowing The Nose In The Pool Is Prohibited.
· Hyperventilation or extended breath holding activities are prohibited.
· Running, boisterous, or rough play in the Aquatic Venue and in surrounding areas is prohibited.
· Animals in the Aquatic Facility, except for service animals as defined by the ADA are prohibited.
· Any Person Using A Public Pool Must Take A Cleansing Shower Before Entering The Pool Enclosure.
· Food and drink within the gated pool area is prohibited.
· Use outside of operating hours is prohibited.
· Drones Are Prohibited.
POOL RULES:
· No Diving, Spinning into the pool, Flipping, or bellyflopping.
· No Running, Horseplay Or Boisterous Activity.
· No Hyperventilation/Extended-Breath Activities Or Games.
· No Food, Drink, Or Glass In The gated Pool Area.
SLIDE RULES:
· Follow Instructions Of The Waterslide Attendant.
· All Sliders Must Ride Independently – Single rider only.
· Maintain proper riding position.
§ Lie on your back the entire ride, feet first, Cross arms over chest, Cross ankles. Hold Position for Entire Ride, Do not sit up.
§ Keep Feet up When Landing in the Pool
§ Keep Hands & Feet Inside The Waterslide At ALL Times.
· No Tubes, Mats, Or Other Floats Permitted While Riding The Waterslide.
· Personal flotation devices are permitted for weaker swimmers, but shall not be provided.
· Do Not Attempt To Sit up. Stop, Slow Down, Spin, Or Steer While Riding The Waterslide.
· Eyeglasses Are Permitted With A Safety Strap.
· No Diving Or Jumping into or out of the Waterslide.
· No Headfirst Or Turning Around On The Waterslide.
· Exit The Slide Pool Immediately.
· Manufacturer’s Recommended Weight Limit: 175lbs Per Single Rider.
· Manufacturer’s Recommended Minimum Rider Height: 48”
· Do Not Wear Jewelry, Loose Clothing, Accessories, Or Clothing With Metal Or Plastic Pieces That May Scratch The Slide.
· No Water Shoes Or Footwear On The Water Slide.
· Riders Must Be In Good Health. Elderly Persons, Those Suffering From Heart Disease, High Blood Pressure, Epilepsy, Or Using Prescription Medication Should Consult A Physician Before Using Slides. Individuals With Medical Conditions Including, But Not Limited To, Pregnancy, Heart, Or Back Problems SHOULD NOT RIDE.
Please Note: Slides can close as early 15 minutes prior to ticket session ending to allow ample time for one final slide by session end. The pool will remain open until session end.
OTHER POLICIES:
Pool Is Open 11:00am – 4:00 Pm Daily – Weather Permitting.
INCLEMENT WEATHER AND REFUND POLICY
We remain open in overcast and light rainstorms.
Thunder, Lightning: Everyone will be removed from pools and slide areas immediately until 30 minutes after the last strike. If you wish to leave, vouchers will be issued to return another day before Labor Day; if you wish to wait the storm out we will instead extend your time if able. No Refunds will be given. Announcements of closure will be posted on our website by 9am daily.
DRESS CODE
Appropriate swim wear must always be worn when using the water park. Swim wear should be properly fitting and shall not indecently expose parts of the body, be transparent, or display obscene or offensive pictures or slogans. Management reserves the right to enforce these policies and in the event that a patron refuses to comply (e.g., by not removing or reversing the offending item, etc.), the patron will be asked to leave the water park and will be issued a full refund.
For safety reasons, swim attire with metal rivets or ornamentation, buttons, or zippers will not be permitted.
Babies, toddlers, and other diaper-wearing individuals are required to wear approved swim diapers when entering any pool or water attraction. Swim diapers are not available at the park for purchase.
Wearing sunglasses or prescription lenses without a safety strap is not permitted when riding water attractions. Due to the nature of all rides and the potential for injury caused by loose articles, unsecured cameras, cell phones, or any recording devices are not permitted on rides.
CHILD SUPERVISION
The water area is completely gated, but all parents/guardians at the park are expected to supervise their child/children at all times. Families/group/parties are encouraged to select a meeting place, in case any member(s) of the group become separated. Lost children should be reported to a lifeguard to assist you in finding your child. Please note that we do not currently have a park-wide paging system.
PHOTOGRAPHY POLICY
As a guest within our park, you may be filmed and/or photographed by a Yawgoo employee or contracted professional. Your entrance into the park serves as permission for use of your image for promotional or social media use.
LOST & FOUND
In the event an article is lost during a ride, Yawgoo Valley will not suspend operations or attempt to retrieve the article. When the slides are properly shut down and safely secured at the end of the operating day, we will make every effort to retrieve and return lost articles. Any items that are retrieved will be kept at Lost and Found for 30 days. If you have found a lost item, please contact a team member, who will have the item taken to Lost and Found. Yawgoo is not responsible for any lost, stolen or damaged items. Report a lost item through our website.
