Participant Liability Waiver

I hereby fully agree to the following terms:

1. I acknowledge that I am participating in classes, special events, or services that offer information and instruction related to yoga, fitness, health, and wellness. I understand that these activities involve physical exertion, which can be strenuous and may lead to physical injury. I am fully aware of the associated risks and hazards.
2. I recognize that it is my responsibility to consult with a physician before participating in any physical fitness program, including yoga. I affirm that I have no medical condition that would impede my participation in physical fitness activities.
3. In exchange for being permitted to participate in yoga, fitness, and other classes, I agree to assume full responsibility for any risks, injuries, or damages—known or unknown—that I may incur as a result of my involvement in the program.
4. Furthermore, I voluntarily and expressly waive any claims I may have against all the instructors and speakers, including Lisa Pumper, Analia Tower, Marco Lee, Erik Leiu, as well as the owner or leaseholder of the premises, for any injuries or damages sustained during classes or special events held at Fort Lauderdale Beach Yoga, Las Olas Oceanside Park, the City of Fort Lauderdale, Yoga Community of Florida LLC, Bonnet House Museum & Gardens, and Bonnet House Beach.
5. I understand that my participation in other classes or events at Fort Lauderdale Beach Yoga, Las Olas Oceanside Park, the City of Fort Lauderdale, Yoga Community of Florida LLC, Bonnet House Museum & Gardens, and Bonnet House Beach (such as yoga, fitness, dance, wellness, or other) will also require me to assume full responsibility for any injuries that may arise, based on the same considerations outlined in this waiver (items 1-4 above).
6. I recognize that all movements, including postures and guidance provided, are only recommendations and not mandatory for every participant. If any movement does not feel appropriate for me, I will cease all activity and may choose to rest, breathe, and enjoy the healing environment.
7. ACKNOWLEDGMENT: I affirm that I am in good physical and mental health and do not currently suffer from any conditions that may pose a risk to myself or others as a result of my participation in these activities. I agree to participate freely.

PROMOTIONAL MATERIAL / PHOTO WAIVER: I grant permission for my likeness, image, voice, and/or appearance to be used in any photographs, video recordings, audio tapes, digital images, or similar media. I waive any right to inspect or approve the finished products and forgo any entitlement to royalties or compensation related to the use of my image. I confirm that I am 18 years of age or older and competent to enter into this agreement. I have read this release prior to signing and fully understand its contents, meaning, and implications. I am free to address any specific questions regarding this release in writing before signing, and I acknowledge that my failure to do so indicates my informed acceptance of the terms.

CODE OF CONDUCT / DAMAGES: Fort Lauderdale Beach Yoga, Las Olas Oceanside Park, the City of Fort Lauderdale, Yoga Community of Florida LLC, Bonnet House Museum & Gardens, and Bonnet House Beach (collectively referred to as "Organizers and Properties") are dedicated to the health, safety, and welfare of the community and all participants. Unreasonable, threatening, obscene, harassing, indecent, or illegal behavior will not be tolerated. Participants who violate the code of conduct or misuse equipment will be asked to leave. The Organizers reserve the right to assess behavior and respond appropriately, which may include termination of class or membership without refund for any member engaging in unacceptable conduct. Participants will be held responsible for any damages to property resulting from their actions or negligence, including those of their guests or dependent children. Not all rules and regulations are explicitly stated in this agreement. The Organizers reserve the right to add, modify, or remove rules, membership conditions, and the timing of classes.

COVID WAIVER: I acknowledge the contagious nature of COVID and understand that the Organizers and Properties have implemented preventative measures to mitigate its spread. However, I recognize that they cannot guarantee that I will not become infected. I understand that the risk of exposure to COVID may arise from the actions or negligence of myself or others, including staff and participants. I hereby release and agree to hold the Organizers and Properties harmless and waive any claims, demands, damages, costs, or expenses arising from my participation in services provided by them. This release discharges the Organizers and Properties from any liability associated with bodily injury, illness, death, medical treatment, or property damage related to services received. This liability waiver extends to the Organizers and Properties, including all owners, partners, and employees.
