Collection Services Waiver Application
Beginning January 1, 2022, California's Senate Bill (SB) 1383 built on existing solid waste, recycling, and organics regulation requiring all businesses and multi-family properties with five units or more to arrange for solid waste, recycling, and organics collection services unless waived. De Minimis Generation Waiver

The City may waive a commercial business’ obligation (including multi-family dwellings) to comply with some or all of the organic waste requirements if the commercial business provides documentation that the business generates less than a certain amount of organic waste material. To qualify for this waiver you must show the City:
- You produce less than 20 gallons of organic waste per week if your combined services are two (2) cubic yards or more
-OR-
- You produce less than 10 gallons of organic waste per week if your combined services are two (2) cubic yards or less.
Reapplication required every five (5) years.

Physical Space Constraints Waiver

The City may waive a commercial business’ obligations (including multi-family dwellings) to comply with some or all of the source separated recyclable materials and/or organic waste requirements if the City has evidence from its own staff, hauler, licensed architect, or licensed engineer demonstrating that the premises lacks adequate space for the collection containers required for compliance with the organic waste collection requirements.

Reapplication required every five (5) years.

Additionally, I understand that this information may be verified by an on-site visit or other process to ensure compliance. I also understand that if the City of Moorpark obtains information at any time indicating that my business or property is no longer diverting material by the method mentioned above, they will rescind the certification. Upon approval, the certification will be valid for up to five (5) years. At the end of the five years, I must reapply for recertification if my business or property falls below the threshold for compliance with state and local recycling regulations.
