    When someone previously held Italian citizenship, but lost it, the way to reattain it is through residency. Even if this decision was made by one's parents or in ignorance of its implications, Italy remains very strict with their response. Normally 6-12 months of residency in Italy is required to reclaim Italian citizenship. You don't need to own a home, but you do need to share your intentions with the Italian Comune and remain there consistently--normally Italian officials will come check your place of residence! The Italian citizenship of your parents or grandparents does not help this scenario in any way, unless you have never been an Italian citizen.

    When an Italian citizen emmigrated and naturalized in another country, the timing was of utmost importance. One of those dates is July 1st, 1912.     **More Information Regarding The Italian Citizenship Law of 1912** 

    The Italian Citizenship Law of 1912, also known as Law No. 555/1912, introduced several important changes to Italian citizenship laws:
    Article 1
    Reaffirmed the principle of paternal lineage, allowing children to inherit Italian citizenship regardless of their place of birth
    Article 7
    Allowed children born in a foreign country to Italian parents to retain their Italian citizenship, even if their parents lost it when they were minors
    Article 12
    Stated that a minor child would automatically lose their Italian citizenship if their father acquired a second citizenship, regardless of where they were born
    The 1912 law reformed and expanded on the Italian citizenship laws previously outlined in the Civil Code of 1865. It became the foundation for all Italian citizenship by descent cases.

    On March 17th, 1861, the Kingdom of Italy was established as the result of the unification of most of the Italian peninsula under the House of Savoy (Piedmont-Sardinia). This unification was the culmination of the 19th century political and social movement known as the Risorgimento, which means "Rising Again" in Italian.

     

    If your most recenty Italian-born ancestor died before this date, then they were never a citizen of modern-day Italy. This means they were never able to pass citizenship on to the next generation, since they never had it to begin with.

    1) 2-3 years of marriage, depending on your place of residency.

    Before 1992, Dual Citizenship wasn't recognize in Italy. If your ancestor naturalized before this date, they were most often required to renounce any allegiance or citizenship to Italy. This would cost them their Italian rights and their ability to pass citizenship on to their kids or future generations. If the ancestor you chose naturalized (became a citizen of the new country) before giving birth to your next in line ancestor, then citizenship eligibility was forfeit. Italy currently provides no way around this. Italy is currently requiring that the eligible ancestor have never renounced Italian citizenship.

     

    If you have another Italian ancestor from a different part of your family tree, you can start the form over and try using that ancestor. The parents or grandparents of the ancestor deemed ineligible will not work.

    You need to choose someone else in your tree who is unrelated to the original subject by blood.
