WHAT IS THE SHAYK® ENFORCER AND HOW DOES IT WORK?

The SHAYK Enforcer is a paid referral service that will put you in contact with a qualified attorney or mediator who can help you enforce any provisions of an executed SHAYK NDA against the countersigning party. Populating this form allows the SHAYK Team to recommend up to three (3) professionals with the ability to help you address your concerns and/or take action.

AM I REQUIRED TO WORK WITH THE RECOMMENDED PROFESSIONALS?

No. If you are not satisfied with your selection(s), then you can utilize the service again with different criteria. This is a human-powered service in which a trained operator actively and attentively works to find an attorney and/or a mediator who can help you seek relief. Therefore, we cannot repeat the process at no charge if you decide not to work with them.

WHY SHOULDN’T I JUST FIND SOMEONE ONLINE FOR FREE?

Go for it. We believe you will find the experience to be confusing and time-consuming, making you less likely to succeed. The SHAYK Enforcer solves that problem for you by putting an expert in charge of the process of identifying, qualifying, and engaging someone to help resolve your dispute.

HOW DOES THE SHAYK TEAM MAKE RECOMMENDATIONS?

The SHAYK Enforcer is a form and a process.

The form above is intended to help our team gain a deep understanding of the opposing party, your issues with their actions, potential damages caused by their actions, and your ability to obtain a satisfactory resolution by enforcing the SHAYK NDA.

The process involves (1) analyzing your submission to help understand what type of professional you need, where you need them, and what you can afford; (2) searching the SHAYK Network of licensed attorneys and mediators to see if there is a good fit so that we can pass our pre-negotiated rates to you; and (3) if needed, searching external networks of licensed providers to ensure the job gets done, leverage contacts and relationships we have build with various bar associations and law societies around the world.

WILL THE RECOMMENDED PROFESSIONALS PROVIDE ME WITH FREE ADVICE?

Maybe. We recommend service providers based on their ability to help you obtain a favorable resolution. Some of them offer free consultations but that is typically not a deciding factor in our recommendations. Nearly everyone we recommend will, however, be willing to provide with you advice if you agree to pay for an hour of their time. While that is not free, for an important matter, experience suggests that acting on good advice from a qualified professional is far better than acting on free advice from the internet.

WILL THE RECOMMENDED PROFESSIONALS HANDLE MY MATTER ON CONTINGENCY?

Most likely not. The key question here is financial damages. If you can provide clear and convincing evidence that someone profited from your Confidential Information, then we may be able to help you find an attorney or mediator who will work on contingency. We caution that this is the exception, not the rule, and the most service providers will require some form of upfront retainer before agreeing to help you.

WHAT IF I AM ENTITLED TO DAMAGES BUT CANNOT AFFORD TO PAY ANYONE UPFRONT?

Three recommendations come to mind. First, breach of contract claims are torts, many of which are governed by a statute of limitations of between 3-6 years, giving you time to get your funds in order. Second, obtaining good advice from a qualified service provider will help you better understand what you can and cannot afford. And third, if the offending actions continue, then so will your claim to any resulting damages, suggesting that someone who declines to represent you on contingency today may agree to do so at a later after, once their are sufficient damages to recover.

CAN I INSURE AGAINST ANY TAKING OF MY CONFIDENTIAL INFORMATION?
